Next Friday (26), the State Department of Education of Pará (Seduc) will publish in the Official State Gazette (DOE), the rules for transferring the first installment of 60% of the principal value of the precatory payment from the Fund for the Maintenance and Development of Elementary Education and for the Valorization of Teaching (Fundef). The payment corresponds to the amount allocated to the teaching staff sheet at the time the transfers occurred, the lowest amount from the Federal Government.

According to the decision of the Federal Supreme Court (STF), in legal process ACO nº 718, the amounts will be passed on to the teaching staff of the state education network of Pará who worked in the period corresponding to April 29, 1999 to December 31, 2003. Basic education teaching professionals who were in a position, job or function, members of the structure, table or table of employees of the State, the Federal District or the Municipality, with a statutory, CLT or temporary bond, will have the right, as long as they are in effective exercise. of functions in the public network.

“This is a very happy moment for education. The State of Pará will receive a significant transfer that will not only benefit the teaching staff at the time of Fundef, within 60% of the main amount, but will also be fundamental for the realization of very important actions for education in Pará, starting from 40% of the main amount, such as the continuous maintenance and reconstruction of our 898 schools, which are so needed, among other programs that are very important for our employees and students”, said Rossieli Soares, Secretary of State for Education of Pará.

The Fund for the Maintenance and Development of Elementary Education and Valorization of Teaching (Fundef) was established by the Federal Government in 1996 and implemented in 1998, with the objective of guaranteeing the transfer of 25% of revenues from States and Municipalities to Elementary Education. Of the total transferred, 60% of the principal amount is exclusively allocated to the remuneration of teaching staff; The other 40% of the main amount is allocated to other educational needs, such as investments in infrastructure, assessments and research, in addition to the acquisition of teaching materials, among other essential actions for the exercise of public education policies.

Conquest – The guarantee of the Fundef transfer is an achievement for the teaching staff of the state network in Pará, which went through a long process that began in 2004. At the time, the State Government contested the amounts transferred by the Federal Government corresponding to the period from 1998 to 2003 In 2020, unanimously, the STF declared the prescription of values ​​relating to the period prior to 4/29/1999, with the period from April 29, 1999 to December 31, 2003 prevailing. From this year onwards, education in Pará will begin. to receive the amounts due for this period judicialized by the State Government against the Federal Government, through legal process ACO nº 718 currently being processed by the STF.

In addition to the resources allocated to education in Pará, when judging ADPF 528, the STF established the understanding that the portion of Fundef court orders corresponding to late payment interest is not subject to the binding rule of art. 212-A of the Federal Constitution. This is because the STF understood that late payment interest has a legal nature distinct from the main one, as it has an indemnifying and autonomous nature in relation to the main portion of the FUNDEF court orders. In other words, the part of the transfer consisting of late payment interest is free for the public entity to use.
