Rede Globo managed to annul a conviction that forced it to pay R$3.5 million to writer Euclydes Marinho, after 41 years as a collaborator at the broadcaster. Minister Luiz Fux, of the Federal Supreme Court, revoked a previous decision by the Regional Labor Court of Rio de Janeiro, which determined the payment of the fine to the novelist. Fux’s sentence is final and cannot be appealed.
Fux concluded that there were not sufficient grounds in the labor process that would favor Euclydes Marinho. Globo had won the case in the first instance, but Marinho’s defense appealed and obtained an initial sentence of R$3.5 million, in addition to R$30,000 in court costs.
After presenting contrary evidence regarding the former employee’s allegations, the broadcaster managed to reverse the decision. Fux mentioned in his verdict that the STF already has experience in similar cases, citing the acquittals of convictions against SBT in the actions filed by Rachel Sheherazade and Hermano Henning, former presenters of that network.
Euclydes Marinho claimed restrictions on his career after his dismissal, arguing that the exclusivity contract prevented him from acting in film and theater projects.
In its defense, Globo refuted Marinho’s allegations, highlighting that the author was allowed to work on projects outside of TV, such as the films “Primo Basílio” (2007) and “Se Eu Fosse Você 2” (2008), and in the play “Shirley Valentine” (1991). Marinho was part of the broadcaster’s team from 1979 until 2022, the year in which he began the process.
During his career at Globo, Marinho contributed to renowned series such as “Malu Mulher” (1979) and “Armação Ilimitada” (1985-1988), in addition to being the main screenwriter on soap operas such as “Mico Preto” (1990), “Andando nas Clouds” (1999) and “Desejos de Mulher” (2002). His most recent works included the series “Capitu” (2009), “As Cariocas” (2010), “O Brado Retumbante” (2012) and “Felizes Para Semper” (2015).
