Fugitive from Mato Grosso do Sul is arrested in Lages; know the crime

The Civil Police of Santa Catarina arrested a man on the run from justice this Thursday afternoon (25). The individual, born in Campo Grande, in Mato Grosso do Sul, was convicted of the crime of association with drug trafficking and lived in the Santa Rita neighborhood, in Lages.

The arrest was the result of a joint action by the Civil Police of Lages and Campos Novos, who were investigating the whereabouts of the individual. After receiving information about his location in Lages, the police mounted an operation to capture him.

The man was arrested at his residence in the Santa Rita neighborhood, without offering resistance. He had been a fugitive from justice since his conviction in the District of Campos Novos/SC, the municipality where the crime of association with drug trafficking occurred.

The crime of association for trafficking is an intentional crime, with a special purpose of action, that is, to traffic drugs or machinery. It requires the grouping of at least two people, with prior adjustment and a certain stability of purpose. It is an independent crime, as in order for the association to traffic to be characterized, it is not necessary to successfully commit crimes under articles 33 and 34 of the Drug Law. It differs from the gang or gang crime that is provided for in article 288 of the Penal Code.

The biggest distinction between the two typical figures lies in the fact that the crime of association for trafficking only requires the presence of two people to carry out the types of activities provided for in articles 33 (drug trafficking) and 34 (machinery trafficking) of the Law of Drugs, whether repeated or not, while gang or gang crime requires the presence of at least 4 people, with the aim of committing crimes, of an undetermined quantity or type.
