Payroll deductions will undergo changes after decree that changes the limit of optional contributions

Active and inactive state public servants, military personnel, public employees and temporary contractors must be aware of changes that may occur in payrolls starting this month. This is because the Decree 57,241/2023which came into effect in April, established limits on consignments, seeking to avoid high debt for civil servants.

One of the main points of attention is control of the assignable margin from Monday (29/4). A The monthly sum of optional contributions cannot exceed 40% of the net remuneration, with 5% allocated exclusively to credit card expenses and the remaining 35% to other types of authorizations, such as monthly fees, health plans, financing and loans. There will be real-time monitoring: if the server is at the limit of its margin, it will not be able to authorize new assignments. Before, this control did not exist.

The margin calculation is made according to the basic salary and other income and fixed payments, such as bonus functions or bonuses inherent to the position. This way, overtime, vacations, substitutions and compensation payments, such as meal allowances, will no longer be counted towards the employees’ consignable margin.

“This change is important because, until then, servers could grant a high number of authorizations for consignments on their payrolls, which exceeded their payment capacity. We have had more than 6 thousand lawsuits regarding consignments from people who declare that they are unable to honor their payments, stating that the interest rates charged by some entities were abusive. In addition to these, there are another 2,700 who filed a lawsuit declaring themselves over-indebted. They are still being processed. The changes seek to prevent this type of situation”, explains the Deputy Undersecretary of the State Treasury, Juliana Debaquer.

From Friday (26/4), when paychecks will be released, employees will also notice another important difference: the Treasury will start making partial debits. If the server takes out a loan of R$500, for example, but his margin is R$350, this will be the total amount deducted, with the remainder being paid directly to the consignee. This will be indicated on the payslip with the inscription DB partial. Until then, when there was no margin available, the State government did not make any type of discount.

Employees who have questions about payroll should contact the Human Resources department of the bodies where they are assigned. For pensioners and employees of Indirect Administration, the changes will only come into effect in the coming months.

Past authorization rules continue to apply

The new decree is effective from April, which means that consignments authorized before that follow the rules of the previous legislation. Thus, there will be employees who will continue to receive discounts exceeding 40% of their net remuneration until the operations are completed. After that, for a possible renewal, it will be necessary to adapt to the new margins.

Other changes

According to the State Treasury, more changes will be noticed in the coming months, as the new decree brings robust changes to the way the State deals with consignments, seeking to bring security and provide transparency to employees. One of the new features planned is the possibility of consulting the value of consignable margins through the Server RS ​​application.

Consignment authorization through facial recognition via the app should also be made available soon. Today, blocking and unlocking can now be done using the technological tool.
