What should change with the return of mandatory insurance?

O DPVAT (Personal Injury by Land Motor Vehicles)known as mandatory land vehicle insurance, stopped being charged in 2020, during the management of Jair Bolsonaro (PL)but it is very close to being recreated by the government of Luiz Inácio Lula da Silva (PT).

The government proposed and the Chamber of Deputies approved on the 9th a bill that reformulates and allows the return of charging to vehicle owners. The proposal, however, still needs to be voted on by the Senate plenary. The vote could take place this Wednesday, the 24th. But after all, what changes with the return of the DPVAT?

The change starts with the name, which in the proposal will be called Mandatory Insurance for the Protection of Traffic Accident Victims (SPVAT). If approved and sanctioned by President Lula, the money raised from insurance charges will be allocated to victims of traffic accidents.

The National Council of Private Insurance (CNSP) will also establish the current compensation values ​​for each year of coverage. In the previous model, compensation for death was R$ 13.5 thousand; for permanent disability, until R$ 13.5 thousand; and reimbursement for medical expenses was up to R$ 2.7 thousand.

According to the proposal sent to the Senate, coverage will include compensation for death, total or partial permanent disability, in addition to medical expenses not available in the Unified Health System (SUS).

Since 2021, the Caixa Econômica Federal operates mandatory insurance on an emergency basis after the dissolution of the consortium of private insurance companies that administered the DPVAT. At the end of last year, however, the bank suspended payments due to the exhaustion of collected resources. The government project keeps Caixa in the insurance operation and expands the list of covered expenses.

Charge

Until 2020, DPVAT was charged every beginning of the year, in January. The contribution amount varied according to the type of vehicle. In the case of SPVAT, there is still no defined charge amount. The text provides, however, that non-payment of the SPVAT will result in a penalty under the Brazilian Traffic Code, equivalent to a fine for a serious infraction, currently R$ 195.23.

Caixa and state traffic departments may sign agreements so that the payment of the SPVAT is made together with the vehicle’s annual licensing fee. The administration fee for this service will be a maximum of 1%.

Payment term

The payment of SPVAT compensation will be made with simple proof of the accident and the resulting damage, regardless of the existence of fault or intent and even if unidentified vehicles or vehicles in default with insurance were involved in the accident.

Caixa will have 30 days to make the payment into the current, payment, savings or social savings account held by the victim or beneficiary. If there is a delay in payment, it will be adjusted by the Broad National Consumer Price Index (IPCA) and default interest set by the CNSP.

In the case of death, if the cause and effect link between death and the accident cannot be proven with the death certificate alone, the interested party must present an autopsy certificate issued by the Legal Medical Institute (IML), even without it having been carried out. requested by the police authority.
