Luan Morais da Silvaaged 24, is the son of Ornaldo Viana, 54 years old, the app driver killed in the early hours of March 31st on Avenida Salim Farah Maluf, east of São Paulo, as a result of a collision with the Porsche of Fernando Sastre de Andrade Filho, who was driving at almost 156 km/h on site. According to the report that heard him, the young man has two-way mood swings: sadness and anger. He said that before the tragedy the family was planning an Easter Sunday when he last spoke to his father. The plans were to go to church in the morning and have lunch afterwards. But the father would not return home alive that day.

“He (Sastre) destroyed my family, put an end to our lives. Mother’s Day will be a lunch without him (Ornaldo). This guy ended up with a story. My father only did good, helped everyone, did community service. He had a dream of visiting his mother who is sick in Maranhão. He saved money to buy the ticket.”he revealed.

Last Friday (3), the São Paulo Court ordered Sastre’s preventive detention and, after he was not found by the police on Saturday (4), he is on the run. The authorities are taking steps in an attempt to capture him. Regarding this, Luan says he is grateful to the work of the Civil Police and believes that justice is being done.

But regardless of whether justice is done or not, the damage is done. The young man revealed that his mother and sister “can’t stop crying” and that he “will always look up” to his father. When asked if he would one day forgive Porsche’s Playboy, he declined to comment.

Remember the case

On March 31, Sastre was driving at 114.8 km/h on Avenida Salim Farah Maluf, which has a speed limit of 50 km/h, when he collided with the rear of app driver Ornaldo da Silva Viana’s vehicle, resulting in his immediate death. According to a report from the Technical-Scientific Police, the Porsche was traveling at 156.4 km/h before the collision.

The judge of first instance, Roberto Zanichelli Cintra, denied the request for preventive detention made by prosecutor Monique Ratton, who alleged that Fernando was driving at high speed and under the influence of alcohol, according to witnesses. The MP also pointed out that the defendant influenced a witness to testify in his favor, violating a precautionary measure.

The fatal accident was recorded by security cameras, and investigations indicate that the driver has already been involved in other traffic accidents, always at high speeds.

The conduct of two military police officers who responded to the accident involving the Porsche is under investigation by the SP Military Police Internal Affairs. They released Fernando Sastre de Andrade Filho, the driver of the vehicle, without carrying out a breathalyzer test, an essential device to check the presence of alcohol in the body.

According to images from the police officers’ body cameras, one of them spoke to a firefighter who provided assistance, confirming that the businessman had consumed alcoholic beverages.

Fernando’s mother, Daniela Cristina de Medeiros Andrade, intervened in the situation, persuading the police to release her son with the promise of taking him to a hospital, claiming that he was injured in the mouth. However, neither Fernando nor his mother sought medical attention.

The final report from the 30th Police District (DP), Tatuapé, indicated that Daniela had helped Fernando escape, but did not indict her for the crime. The Public Prosecutor’s Office also did not hold the woman criminally responsible.

Outlaw Porsche Playboy

Fernando Sastre de Andrade Filho was considered a fugitive from justice last Saturday (4) after the Civil Police went to his home to serve an arrest warrant and did not find him. After having his request for arrest denied three times, the São Paulo Court of Justice (TJSP) ordered on Friday (3) the preventive arrest of Fernando Sastre de Andrade Filho, who became known as “Porsche’s Playboy”.

The Public Ministry (MP) appealed to the TJSP after the court’s decision that had denied the third arrest request made by the SP Civil Police. Judge João Augusto Garcia granted the injunction requested by the MP, decreeing the preventive detention of Fernando Sastre Filho.

The driver of the Porsche is accused of qualified intentional homicide and very serious bodily injury, both in the form of possible intent, which is assuming the risk of killing and injuring.

According to the São Paulo Public Security Secretariat, once he is on the run, security forces take steps to try to find him. If he is not captured over the weekend, his defense announced that he will surrender next Monday (6).

Heard by Uol, lawyer Jonas Marzagão – who defends Sastre – states that he intends to talk to the judge responsible for the case. His objective is to guarantee the physical integrity of the defendant, since the case took on national proportions when reported in the press.

The lawyer also revealed that he will appeal the decision and, if he is unsuccessful, he intends to suggest that his client be sent to the Tremembé prison, in the interior of São Paulo, for security reasons.
