The Special Civil Court of the Federal District denied, this Tuesday 2, the action presented by former president Jair Bolsonaro (PL) and former first lady Michelle for President Lula (PT) to recant after the furniture that allegedly were missing from the Palácio da Alvorada have been found at his own official residence. At the time, the couple also asked for compensation of 20 thousand reais for moral damages.

Judge Gláucia Barbosa Rizzo da Silva understood that the responsibility for any damage caused by the statements lies with the Union and not with Lula personally. The understanding is that the incident happened while the PT member was already in the Presidency position and that, therefore, the action should be filed against the State.

The judge also pointed out that the action filed by the Bolsonaro couple is not suitable for the Special Civil Courts and therefore also dismissed the case.

“Thus, considering that the alleged practice of the act concerns public goods and that this circumstance links the defendant’s statements to the exercise of his position, I recognize, ex officio, his passive illegitimacy“, says an excerpt from the decision. “Any claim for compensation and retraction must be exercised to the detriment of the State (Federal Union)”.
