Vice-president of the City Council is convicted of drunk driving | Tocantins

The vice-president of Pedro Afonso City Council, councilor Wállison Breno Alves dos Reis (PDT), known as Breno Alves, was sentenced to one year in prison for driving under the influence of alcohol. The decision is from the 1st Criminal Court of the municipality.

The defendant’s defense stated in a statement that they tried to prove the councilor’s innocence during the process. The Chamber reported that it has not yet been notified of Breno Alves’ conviction, but as it is a first instance sentence, it will monitor developments. In the sentence signed by judge Milton Lamenha de Siqueira, Breno Alves was cleared of the accusation of having fired a gun due to lack of evidence. The conviction is for traffic crimes, as the councilor was driving at high speed and under the influence of alcohol.

Without a criminal record or behavior that confirmed that he was aware that he committed a crime by driving with impaired cognition due to alcohol, the magistrate determined the sentence of one year, to be served in an open regime.

The councilor also gained the right to appeal the sentence in freedom. However, his political rights will be suspended during his sentence. The penalty may also be replaced by the payment of ten minimum wages, the judge determined.

The defense, based on the elements raised in the indictment, sought to rule out the crimes attributed to the accused throughout the criminal prosecution phase, ensuring his fundamental rights.

The Municipal Council of Pedro Afonso, through President Lili Pereira Benício dos Santos, clarifies that so far it has not received any official communication regarding the Sentence handed down in disfavor of Councilor Breno Alves.

In this aspect, in consultation with the Legal Advisor of the City Council, it was clarified that this is a 1st Degree Sentence, being subject to confirmation by higher authorities, so that the Decision in no way prejudices the Councilor at this procedural point.

Therefore, it is imperative to note that the City Council will monitor the development of the case, and upon final judgment by the Judiciary, it will adopt the appropriate measures.
