According to the first phase of the investigation at the 34th DP (Bangu), the elderly man was in a “screaming life threatening” situation, which could constitute a failure to provide assistance. Érika is also being investigated for vilification of a corpse and attempted theft by fraud. She remains imprisoned in Bangu, in the West Zone.

Now, delegate Fábio Luiz da Sila, head of the 34th DP (Bangu), will complete the investigations to define which crimes Érika will be charged with. The prisoner’s defense, represented by lawyer Ana Carla de Souza Corrêa, contested the inclusion of this criminal classification and said that at the appropriate time she will refute the decision.

“I, Dr. Ana Carla de Souza Corrêa, as Érika’s technician, became aware of the case files that Dr. Delegado included as a criminal classification, adding to the occurrence record, the crime of culpable homicide, and its considerations were based, according to him, on statements made by Ms. Érika herself and also by other witnesses, which the defense rejects, because at no time did Ms. Érika declare that she was Mr. Paulo’s caregiver nor did she carry out this activity, and the witnesses who report at police headquarters they say about the care she had for Mr. Paulo when accompanying him, not that she was a caregiver and these witnesses are people completely removed from the family bond, being people who are strangers to the family relationship. Therefore, the defense, at an opportune moment. , will be contesting and refuting such capitulation.”

Investigations

In her hearing, the woman claimed that Paulo arrived at the bank alive and that he stopped responding when he was being served at the counter. While giving her statement, Érika did not show sadness about the matter, but rather concern about being imprisoned.

The elderly man’s case happened on April 16, inside a bank branch in Bangu. He was taken by Érika, who introduced herself as his niece, to redeem R$17,000 from the loan made in the elderly man’s name. The woman entered with the corpse in a wheelchair and spoke to him normally, even asking Paulo to sign the document authorizing the collection of the money.

Employees at the bank branch became suspicious and called teams from the Mobile Emergency Care Service (Samu). Contrary to what the woman said, the agents identified that Paulo had died around two hours ago, as explained by delegate Fábio Luiz, responsible for the case. According to the holder of the 34th DP (Bangu), cadaveric livers, which are accumulations of blood resulting from the interruption of circulation, indicate that Paulo would not have died sitting, as he was in the chair, but possibly lying down.

Just for the crime of vilifying a corpse, which corresponds to disrespect for the dead, Érika can be imprisoned for one to three years, in addition to having to pay a fine.
