He claims innocence and appeals the decision.

In total, he will spend ten days in a separate cell, according to the Penitentiary Administration Secretariat (SAP-SP), before being integrated. The cell in which Robinho is eight square meters, 2mx4m, consisting of a bed, sink and Turkish basin — a type of toilet built into the floor. According to SAP, the space is intended for up to two people, but the former striker of the Brazilian national team and Santos He is alone for now, until the time for adaptation and assessments carried out by the penitentiary team ends. SAP Resolution 144 of 2010 defines that the inclusion period can last up to 10 days. Then there is the observation time, up to 20 days. Therefore, it is possible for a detainee to spend a month isolated from others. At this first moment, Robinho sunbathed in isolation and had to eat his meals inside his own cell. He is entitled to four meals a day: breakfast, lunch, dinner and snack (optional). The daily menu consists of following options:

  • Sliced ​​cold cuts
  • Breads
  • Sausage or sausage (sliced ​​or ground)
  • Sliced, shredded or ground meat
  • Tie, spaghetti, fettuccine or screw pasta,
  • Assorted grains (beans, lentils, chickpeas, peas, soybeans and white rice).

As soon as Robinho is integrated with the other inmates, he starts to follow the same rules for visits, when family members can take clothes to eat with the inmates or just for them to keep with them. The list, however, is limited and provides a series of rules to ensure that illegal objects do not enter the penitentiary. Lunch boxes are limited to two pots, which must be plastic and transparent. Flour, fillings and meat with bones are prohibited. Layer cakes and stone fruit are also prohibited.

In accordance with SAP standards, the clothes also undergo standardization and are delivered by the penitentiary to each inmate. Each prisoner has access to items below:

  • Pair of sneakers and flip-flops with low soles each
  • Shorts and pants in beige or khaki (no print, no button, no zipper or drawstring)
  • T-shirts are white with a “crew” collar (close to the neck) and cold-weather blouses without a hood
  • White bed and bath linens with no seams, in which objects can be hidden.

In Tremembé, work is focused on gardening and making clothes. The Penal Executions Law determines that one day of sentence is deducted for every three hours worked and one day of sentence for every 12 hours of study. In addition to a library, the site also has a workshop and classroom. Football games and artistic practice are permitted, in addition to freedom of religious worship. The penitentiary has capacity for 584 people (348 in a closed regime, 188 in a semi-open regime and 48 in prisons due to child support debts).

Opened in 1948, the Tremembé Complex It has already been awarded for its prison management model and has become known in the last two decades for having received “famous prisoners”. Despite not being considered a maximum security prison, the location aims to guarantee the privacy of inmates. Suzane von Richtofen, convicted of the death of her parents, brothers Cristian and Daniel Cravinhos, who participated in the crime, and Anna Carolina Jatobá and Alexandre Nardoni, guilty of the murder of Isabella Nardoni, for example.

Led by lawyer José Eduardo Alckmin, the defense of the former Brazilian and Santos striker even filed a request for habeas corpus (HC) in the Federal Supreme Court (STF) to avoid immediate arrest, but the minister Luiz Fux denied the request and maintained the determination of compliance of the penalty on Brazilian soil.

The player’s lawyers argue that he has the prerogative to wait in freedom until the STJ’s decision has become final, that is, when it is no longer possible to appeal. The defense filed a new appeal the day after the arrest, asking for Fux’s decision to be reversed or for the case to be forwarded to the STF Plenary. But the request will only be analyzed after the Easter holiday.
