O Holy Cross filed, this Wednesday (27), an unnamed precautionary measure with a request for an injunction at the Superior Court of Sports Justice (STJD) to play this year’s Series D and suspend the start of the competition. The information was initially given by Beberibe 1285 Podcast and confirmed by lawyer Osvaldo Sestário to the portal NE45.

Last week, Tricolor filed an administrative request with the CBF regarding the vacancy in Série D. The deadline for a response was this Wednesday. As there was no response, the board contacted the STJD.

The request is for the disqualification of the Democrat of Sete Lagoas-MG from competing in Series D. Tricolor’s argument is the lack of technical criteria that justify the inheritance of the vacancy due to the club’s relegation in the state championship.

As a result, the request is for the inclusion of Santa Cruz in application of the CBF’s 2023 General Competition Regulations.

The precautionary measure was filed by lawyers Osvaldo Sestário Filho, Pâmella Saleão de Gouveas, Álvaro Maia Neto and João Otávio Rodrigues Ferreira. The objective is to suspend the start of Series D, scheduled for April 28, until the request is analyzed by the STJD.

Last Friday, an administrative procedure prepared by fans and members of the Santa Cruz Deliberative Council was sent to the CBF so that the entity could review the technical criteria that gave the Democrat of Sete Lagoas the place in Series D 2024, since the club had been relegated in the Campeonato Mineiro in 2024.

Thus, based on articles of the General Sports Law and the General Competition Regulations (RGC) of the CBF, Santa Cruz claims that as it is the best-ranked club in the entity’s National Club Ranking, it would be entitled to the place to the detriment of the team from Minas Gerais. .

The so-called INNOMINATE PRECAUTIONARY MEASURE, with INJUNCTION REQUEST, was recently filed by Santa Cruz Futebol Clube before the Superior Court of Sports Justice – STJD.

The measure aims to obtain the club’s INCLUSION in Series D of the 2024 Brazilian Championship.

Among other facts and grounds, the main ones are the following:

and DEMOTED in the 2023 Minas Gerais Championship, the Democrat of Sete Lagoas, under the terms of art. 193, § 1, of the General Sports Law; It is

(ii) the INCLUSION of SANTA CRUZ in Series D of the 2024 Brazilian Series D Championship, due to the literal application of art. 103, § 4 of the 2023 General Competition Regulations, published by the CBF itself, which states that “§ 4 – In Competitions held and coordinated by the CBF for which the classification of clubs results from their placement in state competitions organized by affiliated Federations, including selective tournaments, if any club withdraws or does not confirm its participation, CBF WILL BE RESPONSIBLE TO ALLOCATE THE VACANCY TO A NEW CLUB, USING TECHNICAL, EQUAL, AND EQUITABLE CRITERIA THAT PRIVILEGE THE PROMOTION OF FOOTBALL, AND MAY ADOPT THE UPDATED RNC AND ASSIGN THE VACANCY TO A CLUB FROM ANOTHER FEDERATION”.

In the end, the Precautionary Measure filed by lawyers Osvaldo Sestário Filho, Pâmella Saleão de Gouveas, Alvaro Maia Neto and João Otávio Rodrigues Ferreira seeks, as a preliminary measure, to suspend the start of the BRAZILIAN CHAMPIONSHIP SERIES – D/2024, until the SANTA CRUZ’s intention to investigate the allocation of the vacancy occupied by the Democrat of Sete Lagoas (MG), so that it can be allocated to SANTA CRUZ, and, in the end, that SANTA CRUZ’s intention is recognized, so that it can be allocated the vacancy in the Series D of the 2024 Brazilian Championship, due to the disqualification of the Democrat of Sete Lagoas and the consequent application of the national ranking of clubs, as stated in the General Competition Regulations of 2023, which has SANTA CRUZ as the best placed among the 64 clubs of the 2024 Series D.
