The judge and former head of the district of Coari, Fábio Alfaia, received the sentence of “censorship”, after the Federal Public Prosecutor’s Office delayed the magistrate in a procedural progress in which one of the defendants was the former mayor of Coari, Adail Filho. The sentence was handed down on Thursday (16) by the National Council of Justice (CNJ).
g1 contacted the Amazonas Court of Justice (TJAM) and the judge to find out their position regarding the penalty applied, but was unsuccessful.
In the process, the MPF also pointed out that the judge made decisions in the case even though he was no longer competent to judge the case.
For the organization, Alfaia’s actions would have benefited the political group of the former mayor, now a federal deputy.
The case’s rapporteur, counselor Marcello Terto, stated that the process was stopped for 240 days. According to him, the delay in the procedural progress was due to the lack of structure and technical capacity of the municipality’s judicial unit. However, this does not take away the responsibility of the magistrate, being subject to disciplinary punishment.
According to the organic law of the national judiciary, the judge who receives the penalty of censure is prohibited from being promoted due to merit during the period of one.
In a trial held on Tuesday (16), the deputy attorney general, José Adonis, asked for the judge to be removed from office for a period of 60 days. The magistrate has been away from his duties since March 2023.
