Court grants injunction to resume bridge bidding in the South Zone of Aracaju | Sergipe

The state of Sergipe obtained, this Wednesday (3), an injunction in court so that the process for the construction of the bridge that will connect Avenida Tancredo Neves, in Bairro Inácio Barbosa, to Bairro Coroa do Meio, in Zona South of Aracaju. On March 25, the bidding had been suspended by the Court of Auditors (TCE).

In the decision, judge Elbe Maria de Carvalho highlights “that she does not verify the fulfillment of any of the requirements (fear of serious harm to the Treasury, public assets, the exercise of external control, or individual rights) for the Court of Auditors to had granted the precautionary measure suspending the bidding procedure at that time and, much less, qualifying the consortiums whose appeals against disqualification were still in the timely judgment phase.”

The judge also says that the Court of Auditors’ decision could “cause serious losses to the public treasury, as the suspension of the bidding procedure will result in a delay in the beginning of works and extension for completion, which “will result in the payment of amounts above those already agreed “. It also highlights the harm to the population, given the problems with urban mobility that it has already been facing.

To the g1the TCE informed that it was notified and will be subject to analysis by the legal department.

The notice for bidding on the work was signed by governor Fábio Mitidieri in September last year. The complex includes the construction of a viaduct, cable-stayed bridge over the Poxim River and cycle path, to relieve traffic on Tancredo Neves and Beira Mar avenues. The total investment is R$ 363,961,232.20.
