The document also says that “electoral propaganda is a powerful instrument of information and the implementation of popular sovereignty”. Lawyers argue that Lula only appeared in 4 seconds of the advertisement.

Merit analysis. As Dino had not ruled on the main subject of the appeal – but alleged technical impediment -, the defense asks the Court to analyze the merits of the case.

Election propaganda

The case went to the Supreme Court after the TSE considered that the possibilities for appeal had been exhausted.

Bolsonaro was ordered to pay R$70,000 for irregularly promoting content against Lula at the time of the elections. A 4-minute video, published on the PL’s YouTube channel, associated the then PT candidate with negative images and terms such as “thief” and “system enemy of the people”, but without making it clear that it was propaganda.

Declaration of impediment. During the hearing in the Senate before being sworn in as minister, Dino was asked about declaring himself unable to judge the former president. At the time, he said that he had no enemies and that he had already had lunch with Bolsonaro in Planalto when he was governor of Maranhão.
