SÃO LUÍS – The president of the Children and Adolescents Foundation of Maranhão (Funac), Sorimar Saboia Amorim, was removed from her position this Friday (26). The decision came from the 2nd Children and Youth Court of São Luís, of the Maranhão Court of Justice, in response to a request from the Public Ministry (MP-MA).

According to the MP, Sorimar Saboia failed to comply with obligations that were determined in a court ruling of July 6, 2017. The decision, confirmed on June 10, 2021 by the Court of Justice, determined the regionalization of the provision of socio-educational hospitalization measures in units in the most distant regions of São Luís and the regularization of the registration of socio-educational units located in the metropolitan region of the capital.

According to the sentence, the State and Funac concentrated the hospitalization units only on the Island of São Luís, which disobeys the Law of the National Socio-Educational Service System (SINASE), the National Socio-Educational Service Plan (2013/2022) and the Resolution 05/1998 of the State Council for Children and Adolescents-CEDCA.

According to the regulations, the regionalization of hospitalization measures must consider the distribution of the population, with the purpose of guaranteeing the right of adolescents to be close to their family and community. Initially, regionalization in Maranhão should serve the centers of São Luís, Imperatriz, Caxias, Itapecuru-Mirim, Presidente Dutra, Pinheiro, Balsas and Bacabal, according to the CEDCA resolution.

However, the units for compliance with socio-educational measures (from six to three years) are concentrated only in São Luís (three). In Imperatriz, there is only a small improvised unit.

In flagrant seizures, Funac shelters teenagers from the districts of São Luís (4 municipalities), Imperatriz (3 municipalities) and Timon (1 municipality). In other municipalities, apprehended teenagers remain at the police station for five days.

Still according to the sentence, Funac also did not regularize the agency’s units with CEDCA, which are all unregistered and without reports from the Fire Department and Health Surveillance.
