Video shows moment in which 5-year-old child is dragged and forcibly taken by her mother

A mother, without custody of her son, took the child by force from his grandmother in Santos, on the coast of São Paulo, and fled with the boy. In the images obtained by g1this Wednesday (24), it is possible to see it being dragged and placed inside a car. The father and grandmother have been taking care of the boy for three years and recently obtained the joint custody of him with urgent protection.

“I’m devastated and my mother can’t stop crying. It’s a trauma she caused to my mother and my son,” said the father, Eduardo Cassiano, 50, who is a road transport assistant.

Eduardo explained to g1 that he never had a bond with the woman, who, according to him, left him with the boy approximately three years ago and showed up to visit every two months.

“What she is doing with a five-year-old child is not the correct attitude of a mother”, he said, about the action carried out around 8 am on Monday (23), when the boy was taken to the school.

At the end of 2023, the boy went to spend Christmas at his mother’s house in São Paulo and, when he returned, his grandmother complained that the boy was sick. According to Eduardo, the situation was a trigger for threats, including photos of plane tickets to Aracaju (SE).

Afraid, at the time Eduardo filed a police report for threats and filed a lawsuit to regulate shared custody with his grandmother. The objective was to ensure that the woman could only visit the boy with supervision.

The judge of the city’s 2nd Family and Succession Court, Suzana Pereira da Silva, granted a guardianship of urgencyi.e, met Eduardo’s request provisionally, until the process is finalized.

Even with the court’s decision, Eduardo told the g1 that the woman tried to take the boy by force from school, judo class and even at Easter. “She pretended to take the Easter egg, grabbed it and ran away, but I managed to stop her and bring it back to my house,” she recalled.

The kidnapping was carried out on Monday morning (23), around 8 am. According to the police report, the boy’s grandmother was taking him to school, when she was surprised and pushed by his mother. “The child threw himself and shouted: ‘Grandma, grandma’,” said Eduardo.

In the video, you can see the woman wearing red clothes. She grabbed the boy by the arm and he fell. His mother dragged him and then carried him to a car. A person, who was not identified, was already waiting in the driver’s seat to leave with the vehicle. The elderly woman tried to reach them, but couldn’t.

Eduardo said that the last news he had about his son was sent by the boy’s maternal grandmother hours after the woman ran away. “Her mother told me that they are already on their way to Aracaju.”

Eduardo believes that his son is still in the State of São Paulo. Therefore, he contacted lawyer Talita Alambert, who registered a police report at the 3rd Police District (DP) of Santos and filed a request with the Court for a search and seizure warrant for the minor to be issued.

O g1 had access to the document from the Public Ministry (MP) that gave a favorable opinion for the warrant to be issued on Tuesday (23). Now, the family is confident that it will be approved by the Court of Justice of the State of São Paulo (TJ-SP) this Wednesday (24).

The person responsible for the defense said that the mother committed two crimes: Assaulting an elderly woman and abducting a minor. But, the focus is on finding the boy. “We need help locating the child before he actually leaves the state and makes it much more difficult to locate,” said Talita.

Even without custody of the child, the lawyer and vice-president of the Brazilian Bar Association (OAB) of Praia Grande (SP), Natália Bezan Xavier Lopes, explained to the reporting team that it is not a crime of kidnapping because it is not there was interest in obtaining a financial advantage.

“What we have is the subtraction of incapable. [De acordo com o Código Penal,] she can be arrested [e pegar pena] from two months to one year […]. There may also be a request for moral damages depending on the inconvenience”, said the lawyer.

If the minor did not suffer ill-treatment or deprivation, Natália stated that the Court may stop applying the penalty. In any case, the woman must be fined for failing to comply with a court order for custody and visitation, as provided for in the Child and Adolescent Statute.

O g1 tried to contact the defense of the woman who disappeared with her son, but could not locate her until the last update of this report.
