The Ministry of Labor is celebrating the victory in court in overturning the injunction granted to the Federation of Industries of the State of Minas Gerais (Fiemg), which exempted companies with more than 100 employees from disclosing salary transparency reports, as provided for in the Law 14,611, of July 2023, which deals with equal pay between men and women.

“We filed a request for our information to be accepted, because much of the information said was not correct. Let’s agree, people are having difficulty understanding the data, but the intention is not to fine, but to provide transparency about the salary differences between men and women in all countries, not just in Brazil”, explained Paula Montagner, Undersecretary of Statistics and MTE Labor Studies, this Wednesday (27/3). The decision in favor of the government took place on Tuesday night (26/3).

The undersecretary said that the data from the partial report on wage inequality, released on Monday (25/3), were collected from 49 thousand companies and represent around 17 million workers. “I was at the G20 meeting (group of the 19 largest developed and emerging economies on the planet plus the European Union), where we raised the topic of pay and gender equality and saw that there is a fundamental aspect: all countries have problems”, summarized.

Montagner recalled that, at Monday’s event, the Minister of Women, Cida Gonçalves, highlighted that, at the rate we are going today, equal pay in the world will only occur in 300 years, that is, more or less, in six years. generations. “Therefore, we think we are very interested in accelerating this process”, she pointed out.

When contacted, Fiemg informed that it intends to appeal the decision of the president of the Federal Regional Court of the 6th Region (TRF6), federal judge Monica Jacqueline Sifuentes, who suspended the injunction favorable to the entity.

“We are defending society, to prevent its data from being exposed and used for improper means. We do not understand the point of publishing specific income data, both for men and women”, said, in a statement, the president of Fiemg, Flávio Roscoe. According to him, declarations for Income Tax purposes are confidential and now information about income may be disclosed. “This data will be exposed in the report, as the company has to publish it in a highly visible location,” he added.

The president of Fiemg refutes the argument that the non-disclosure of the reports violates women’s right to equal pay. “We defend meritocracy, yes, for both genders, and we defend equality for everyone, regardless of gender, race, age. We are confident that we will be successful at the end of all these legal demands”, he added in the note.
