The State Public Services Regulation Agency states that the rebalancing of the MS-306 concession contract with the company Way306 will help to “mitigate the impact of toll adjustments” on the highway, which will be restricted to inflationary replacement of the last twelve months.

Agems approved changes to the contract value after verifying an “imbalance” of R$12.5 million. Way306 is responsible for 219.5 kilometers of MS-306, which runs through the municipalities of Cassilândia, Chapadão do Sul and Costa Rica. The company closed 2023 with a profit of R$16.2 million. Currently, the toll on the highway is R$11.80.

According to Agems, the financial project, profitability and expected return are part of the contract when establishing the concession. And regulation takes care to ensure this balance, which, according to technical studies, was broken, resulting in a deficit of R$ 12,568,641.04.

One of the renegotiation measures will be the “postponement of some investments”, to avoid an increase in tolls greater than inflation.

“The data verified by the Regulatory Agency follows the contractual commitments of the Grantor with the concessionaire – Financial Project – previously agreed, different from the business management performance demonstrated with other general balance sheet data of the group. The project provides for a previously established rate of return (IRR) and in the event of a different rate, the contract must be rebalanced”, informs the State Regulatory Agency, in a note this Wednesday (27).

“The economic regulation promoted by AGEMS will still generate the benefit of mitigating the impact of toll adjustments. With the postponement of some investments that will compensate for the deficit of R$ 12 million, there will be no transfer of this deficit, the adjustment being only the inflationary replacement of the last twelve months”, explains the State Government body.
