The Justice of Mato Grosso determined the partial closure of the Várzea Grande Resocialization Center (Capão), arguing overcrowding, possible mistreatment and violation of prisoners’ rights. The decision was made by Judge Geraldo Fernandes Fidelis Neto and was published last Friday (22).

The state must adopt the following measures:

  • Transfer, within 120 days, 128 prisoners who are in excess;
  • Keep a maximum of 30% of the population above capacity;
  • Prohibit the entry of any custodian from another District into the Várzea Grande Resocialization Center;
  • Communicate the competent bodies for reporting;

In case of non-compliance with the decision, daily fine of R$10,000. The Public Security Secretariat reported which has not yet been notified of the decision.

In the document, the judge argues that, currently, the unit is experiencing overcrowding, approximately 160%, which implies the violation of numerous rights of those deprived of liberty and, in a special way, the principle of human dignity.

“The conditions experienced in the unit ‘have been progressing rapidly, without the State providing any measures to resolve or, at least, alleviate the problems existing in the prison unit’”, says an excerpt from the document.

The document also cites reports of possible mistreatment and torture suffered by prisoners, resulting from the excessive and indiscriminate use of pepper spray by the special team of criminal police officers, who are assigned to work in the unit.

“A Overcrowding does not allow for the correct separation between provisional and convicted prisoners, between first-time offenders and repeat offenders or even prisoners over the age of sixty or faction leaders, [….] the person enters the Penitentiary System to be restructured, rebuilt, recovered, but, in current conditions, without any possibility of resocialization, you will leave much worse off than you entered“, he concluded.
