BBB 24: Understand if Mani is entitled to part of Davi’s prize

Davi Brito, the great champion of this year’s Big Brother Brasil, confirmed the end of the relationship with Mani Reggo this Tuesday (23) and, now, raised the question: what about the prize? The Bahian it won the value of R$2.92 million.

According to lawyer Vanessa Medeiros, a specialist in family law, Davi already demonstrated that he was in a stable union even if there was no recognition on paper.

— He will have to divide the assets — says the lawyer. This is because, according to her, in this type of relationship partial community of assets applies, that is: what was acquired during the union (in this case, the BBB 24 award), must be divided equally between the couple.

— In this way, the BBB award would be included in this sharing, and must be divided into 50% for each person, if the stable union is proven. This is a way that Brazilian legislation has to protect the rights of partners even in the absence of formalization of the union, something that is common today — he explains.

What is a stable union

A stable union exists when two people, regardless of sex, establish a public, continuous and lasting coexistence, with the intention of forming a family. There is no need to comply with any formalities or have any certificate to recognize the union, although this provides greater legal (and property) security for the couple.

To prove it, a series of documents and evidence of life together can be used, such as proof of common address, statements from shared accounts, partner’s dependence on health insurance or income tax, photos of family moments and witnesses.

In a stable union, the default regime is partial community of assets, unless the couple chooses another regime when recognizing the union. Vanessa explains that, in partial communion, assets acquired during the union, through common effort, even if only in the name of just one of the spouses, or assets acquired by eventual fact — such as the Big Brother Brasil prize — are divided between the two .

But there are also other property regimes, such as total separation, universal communion and final participation in assets, the latter being rarer. It is also possible for the couple to create a hybrid property regime, mixing clauses from all existing regimes.

But opting for one of these property regimes requires formalization at a notary’s office, through a stable union deed or prenuptial agreement.

Brazilian legislation does not establish a minimum period of relationship for the stable union to be recognized. If the legal requirements are met (public, continuous and lasting coexistence with the intention of starting a family), time matters little, says Vanessa.

David confirms breakup

Davi confirmed the end of his relationship with Mani during the recording of the program Altas Horas, on Tuesday (23). In a video released by columnist Léo Dias, he says that the people around him did not know how to respect the moment he left the program.

— I wanted everyone, everyone, my family, to respect me a little because I needed a moment to think about what is happening. But, in general, they didn’t respect me much, they bombarded me with information. I stopped on the bed and was in a state of shock — she says.

Then, Davi confirms the end of the relationship with Mani and said that he asked for calm to talk to her when he arrived in Salvador.

— And even my own ex-girlfriend, she broke up with me, she didn’t know how to respect my moment, what I was experiencing […] Let’s return to Salvador to talk, continue our lives, with money or no money, let’s continue living our lives. Everything that’s happening is crazy — she says.

Mani also vents

On Tuesday night, Mani published an outburst on social media and said he will not “throw stones at Davi”.

“For those who expect me to lower the bar and resolve my issues via the internet, I’m sorry to disappoint, but I won’t do that”, he says.

She also said that she will keep everything that happens between her and the BBB 24 champion confidential and that, on social media, she will only talk about what she adds for the future.

“I will not quote, nor expose conversations, meetings… I will not feed spectacular narratives that have the sole objective of becoming a topic and hurting people. Only expect respect and hard work from me to take care of my family and those around me!”, he points out.
