Camila Moura took social media by storm this Thursday, 28th, with an alleged “flagra”. The teacher and wife of Lucas Buddhawhich is confined in the “BBB24“, was photographed leaving a motel with an unknown man. Even though she was accused of setting up the scenario, she could still be sued by her husband.

A This is People, lawyer Dr. Enio Martins Murad explains: “It is possible to demand, through an action, compensation for moral damages, when there is adultery. This specific case, when a woman is caught with another man at the motel while still married, is considered adultery.”
And, according to the expert, Camila may have produced evidence against herself when being photographed — intentionally or not.
Remember the case
At the beginning of March, Camila deleted photos from her Instagram with her then husband, Lucas Henrique, after the professor’s flirtations with Giovanna Pitel on “BBB24”. She then began to expose her daily life and denounce her brother on her social networks, ending up being hospitalized after the incident.
With the exhibition, Camila gained more than three million followers, while Buddha has 200 thousand. Still confined, the professor has been missing his wife in the reality shows that show the participants’ families, but still doesn’t know that he is single.
Is adultery a crime?
On March 28, 2005, Law 11,106 revoked article 240 of the Penal Code and decriminalized adultery. Despite this, Dr. Enio explains that the practice is considered “an ideological and moral betrayal” in marriage.
“In Brazil, there is already jurisprudence. Betrayal between a husband and wife can generate the duty to compensate, because there is pain, a feeling to be repaired. Because the harm could not be avoided, the person was subjected to ridicule. This gets worse when it goes to the media. When there is a violation of the right to privacy, honor and image, compensation will always be due”, comments the lawyer.
But what about the flirtation with Pitel?
It’s true that Lucas’ attitudes within “BBB24” started all the confusion with his wife. However, Dr. Enio opines: “If she [Camila] understand that flirting [entre Buda e Pitel] causes moral damage, you may try to sue in the same way. Now, being caught at the motel, compared to a reality show where nothing happened…,” she says.
