After being integrated into the common area of ​​the Tremembé II Penitentiary, in the city of Tremembé (SP), Robinho was able to practice leisure activities with other inmates, including football games, which he did professionally for 18 years. The former Brazilian national team player maintains his innocence in the case in which he was convicted of raping a woman in a nightclub in Milan, Italy.

In addition to football, there are other leisure activities planned for Tremembé II inmates. According to the São Paulo Penitentiary Administration Secretariat (SAP-SP), theater and English workshops, film sessions followed by comments, religious actions and musical rehearsals are offered. Robinho is a fan of pagode and, during his public life and in behind-the-scenes images of some of the teams he played for, he appeared singing and playing percussion instruments.

Work and study activities are also available. These are different from leisure time and are the ones that have an impact on the sentence applied to each prisoner. Work is defined by schedule, with shifts lasting six to eight hours. The Penal Executions Law determines that one day of sentence is deducted for every three served. There is also the possibility of studying for remission of the total sentence. For every 12 hours of classes, the player will have one less day to serve in jail. In this case, primary, secondary, including vocational, or higher education activities are considered, or professional requalification activities, divided into at least three days.

Article 112 of the same law discusses the time for serving the sentence. Robinho was sentenced, in Italy, to nine years in prison. According to Brazilian legislation, valid after the approval of the sentence by the Superior Court of Justice (STJ), a first-time offender who commits a heinous crime (such as rape, in Brazil) serves at least 40% of the sentence in a closed regime. Therefore, Robinho must be imprisoned for at least 3 years and one month until he can progress in serving his sentence.

Meanwhile, representatives of the former player are trying again for Robinho’s provisional freedom at the Federal Supreme Court (STF). Two other requests for habeas corpus have already been sent to the Court and denied. The understanding is that Robinho should remain free until the body analyzes the STJ’s decision to apply the Italian court’s penalty in Brazil.

TEAMS IN PRISONS HAVE ALREADY COUNTED ON DANIEL ALVES AND RONALDINHO

In 2023, full-back Daniel Alves participated in a game at the Brians 2 Penitentiary Center, in Barcelona, ​​Spain, where he was until last month, when he was granted provisional release through freedom control measures and a bail of 1 million euros (R$5.4 million). The Brazilian was sentenced to nine years in prison for raping a young woman in a nightclub in Spain. He claims innocence and is trying to appeal his conviction at the Superior Court of Justice of Catalonia.

Three years earlier, Ronaldinho Gaúcho was caught playing matches at the Agrupación Especializada, a prison where he was detained in Asunción, Paraguay. In addition to the player twice voted best in the world, his brother, Assis, was also imprisoned. The two entered Paraguay with false documents and spent six months in prison until they were granted house arrest followed by bail upon payment of US$1.6 million.

Robinho was accused of participating in the gang rape of a young Albanian woman at the Sio Café nightclub, in Milan, in 2013. The investigations involved telephone interceptions carried out with judicial authorization and which showed the former Santos player revealing his participation in the act. In 2017, when the player was at Atlético-MG, he was convicted in the first instance. This did not stop him from continuing his career. Santos announced the signing of the striker in 2020, but he didn’t even play after protests from fans and threats of breaking contracts with sponsors. The contract lasted six days and was suspended. At the time, the Milan Court of Appeal had already denied appeals from Robinho’s defense.

Finally, the case became final in Italy in 2022, with the conviction at the Court of Cassation in Rome, the highest body of Italian justice. Robinho, however, was only arrested after the Brazilian court approved the sentence given in the European country.
