New images recorded by the body cameras of military police officers, who responded to the Porsche accident that left app driver Ornaldo da Silva Viana dead, show the agents explaining the release of businessman Fernando Sastre de Andrade Filho, who was driving the car luxurious. The video was released exclusively by TV Globo.

“Then his mother arrived: ‘No, you need to help him, it’s not okay… I’m going to the PS’. Of course, I won’t say, ‘no, you won’t help’, but he is the driver. There was a witness that He said that apparently he was responsible for the accident and he left the scene. So: he left to be helped. So we go to another PS. [Pronto Socorro] to see if he is really there, if he was attended to, how he is,” said the military police officer who released Sastre.

The conversation was recorded while the PM officer spoke to another officer on the phone and explained that she released the businessman because his mother said she would take him to the hospital. However, despite promising to seek medical help, the two did not seek hospital care.

During the journey, the police officer and the other PM who accompanied her during the incident went to the hospital where Ornaldo had been taken injured, but he did not resist and died. “He just died. I’m waiting for the death certificate here at the PS,” said the police officer.

Still in the conversation, the military police officer also shares information about the health status of the Porsche driver’s friend, Marcus Vinicius Machado da Rocha, who suffered serious injuries, including four broken ribs and the need for surgery to remove his spleen.

“Both [Fernando e Marcus] apparently their lives are not at risk,” said the police officer.

Error in the procedure

An investigation carried out by the Military Police found that there was a failure in the procedures of the police officers who responded to the incident. In a note released during the investigation, the SSP stated that the investigation analyzed the police officers’ body cameras and identified that the team made a mistake by not subjecting Andrade Filho to a breathalyzer test.

Upon discovering the error, a process was opened to hold the police officers involved in the case accountable, said the SSP. The forensic reports and images from body cameras were handed over to the Civil Police, which is investigating the case.

The ministry also pointed out that a 3D reconstruction of the accident is being carried out, which should help the investigations, which are now in their final phase. The case remains under judicial secrecy, highlighted the SSP.

The maximum speed allowed on Avenida Salim Farah Maluf, where the accident occurred, is 50 km/h, three times slower than the speed of the Porsche driver. The information is from the Technical-Scientific Police report.

The speed of the luxury car at the time of the collision was estimated by experts after analyzing images from security cameras, which recorded the incident. However, the report presented is just one of the documents to be delivered to the Civil Police. The Criminalistics Institute (IC) and the Legal Medical Institute (IML) must also prepare conclusions.

Court ordered arrest of businessman

Last Friday, the 3rd, the Court ordered the businessman’s preventive detention, following an appeal from the São Paulo Public Ministry (MPSP). Previously, three arrest requests against him had been denied in the first instance. After three days on the run, Fernando Sastre Filho presented himself this Monday, the 6th, and was arrested.

According to the São Paulo Public Security Secretariat (SSP-SP), Fernando, who was charged with intentional homicide, bodily harm and escape from the scene of an accident, is provisionally detained at the 5th Sectional Police Station, in the East Zone of the capital of São Paulo. Afterwards, he will be sent to the custody hearing.
