The court understood that the police could have prevented the invasions of the buildings of the Three Powersif they had acted correctly.

According to the complaint, the police were negligent in the actions of January 8. According to the PGR, they were aware of the coup movements in the Bolsonaro camp set up in front of the Army headquarters in Brasília, but “they refrained from fulfilling the protection and surveillance duties imposed on them.”

In the PGR’s interpretation, the omission meant that the police officers “subjectively adhered to the criminal actions”. The complaint states that some officers suffered “ideological contamination” and adhered to “conspiracy theories about electoral fraud and coup theories.”

Permissiveness

According to the complaint, Major Flávio de Alencar commanded the detachment responsible for the Chamber of Deputies, in which Colonel Fábio Augusto da Silva also participated.. And it was from the Hat Shop and the Black Room of the Chamber that the coup plotters entered the National Congress. According to the PGR, there was “permissiveness” on the part of the police officers.

“On the premises of the Chamber of Deputies, especially in the Black Room, in the Domes and in the museum, historical goods and furniture were destroyed and deteriorated. The members of the crowd also burned the carpet in the Green Room of the Chamber of Deputies”, says an excerpt from the complaint.
