Rio – Former Rio councilor and former military police officer Gabriel Monteiro was charged with the crime of abuse of power related to three cases that occurred in 2021, when he was still serving as a parliamentarian. According to the Public Ministry of the State of Rio de Janeiro (MPRJ), Monteiro invaded shelter institutions without a court order, prior notice or authorization from management.

The complaint was made taking into account article 22 of the law on abuse of authority: “invading or entering, clandestinely or cunningly, or without the will of the occupant, someone else’s property or its dependencies.”

According to the document, distributed to the 36th Criminal Court of the Capital, last Monday (29), Gabriel entered three different institutions, in the year 2021, without a court order, prior notice and authorization from management, outside of working hours and in disagreement with the rules of the City Council. In all three cases, Monteiro would have taken advantage of the moment when employees opened the gate to provide information, and invaded the premises, always accompanied by a film crew. In two cases, he would be with armed men.

The MPRJ reported that, on February 18, 2021, the former councilor invaded the Ana Carolina Shelter, in Ramos, in the North Zone of Rio. The place houses children at risk.

On March 18 of the same year, Gabriel invaded the Raul Seixas Reception Institution, in Praça da Bandeira, also in the North Zone. Witness reports indicate that he was there accompanied by thirteen armed men, including some of them carrying long weapons. The institution welcomes teenagers aged 12 to 18.

On March 24, 2021, he invaded the Taiguara Reception Center, in Cachambi, still in the North Zone. The house shelters children and teenagers at risk.

As stated in the complaint, all the invasions occurred at night, after 7:30 pm. The text highlights that the former parliamentarian “even invaded the dormitory where the female teenagers were staying, without worrying about the privacy of the host. There was also a baby in the room, just one and a half years old. , who cried compulsively, as she was frightened by the camera lights, by the strangers around her and by all the confusion caused by the accused”.

What does the defense say?

Lawyer Sandro Figueiredo, who represents Monteiro, claimed that the former councilor had all his actions based on legality, especially his inspections, taking into account articles of the Federal Constitution and the Organic Law of the Municipality of Rio, which deal with the rights of parliamentarians to monitor

“The right to inspection goes much further than a right. It is a duty that every parliamentarian has to monitor public bodies so that the bodies can serve the people. Therefore, all of Gabriel Monteiro’s attitudes have always been based on legality and with legal basis. The defense will certainly prove Gabriel Monteiro’s innocence in this case, which was brought against him”, he commented.

Other MPRJ complaints against Gabriel Monteiro

The former councilor has been in prison since November 2022, after being reported and becoming a defendant for the crime of rape. At the time, Monteiro handed himself in at the 77th DP (Icaraí), in Niterói, in the Metropolitan Region of Rio. The complaint that generated his arrest warrant mentions that Gabriel “freely and consciously, filmed, via cell phone, a sex scene explicit” with a young woman who, at the time, was 15 years old.

Furthermore, the former PM also became a defendant, at the end of June 2022, for the crimes of sexual harassment and sexual harassment. In this case, the investigation was investigating possible crimes against the former advisor to parliamentarian Luiza Caroline Bezerra Batista, aged 26.

In May 2023, Monteiro was reported for persecution and contempt of a superior.
