In unreleased body camera videos, PM and firefighter say Porsche driver was drunk; watch

This Thursday (25), new body camera videos, obtained by g1, showed that the driver of the Porsche, Fernando Sastre de Andrade Filho, was drunk. The information was given by one of the firefighters who was at the scene of the accident, which resulted in the death of app driver Ornaldo da Silva Viana, and one injury. Just yesterday, the São Paulo Civil Police requested the businessman’s arrest for the third time.

At the beginning of the filming, the police listen to witnesses who witnessed the accident. According to them, the businessman crashed into a Sandero at over 100 km/h on a road with a maximum speed limit of 50 km/h, and even tried to escape after the crash. “They passed us. He passed at around 200 km/h, tried to avoid one car and hit the other. (…) We were the first to get out and help them out of the car. They wanted to escape, but we held them back”recalled a couple.

At this moment, Fernando is seen leaving the scene of the accident alongside his mother, Daniela Cristina de Medeiros Andrade, when he is approached by the police. Then, the police officer asked a colleague if he had a breathalyzer to perform the breathalyzer test. The agent replied no. According to the regulations, it is not mandatory for every vehicle to carry the respective items. However, in these cases, the default is to ask another team for the equipment.

After receiving a negative response, the agent interrogates Fernando about what happened. “I was going out with Marcos (friend), we were going home. And then a horrible accident happened. That’s it. We were leaving a party and going to my house to play pool. Then, out of nowhere, a horrible accident happened. I don’t remember anything anymore”informed the Porsche driver.

At no point in the recording do the agents question whether the businessman drank before driving. They collected Fernando’s data and made him sign a statement to release him. According to the driver’s mother, he would be taken to the hospital. However, as pointed out by the report itself, they were not admitted to any health unit. In testimony, Daniela said that they went home to take a shower and ended up sleeping.

Shortly afterwards, a firefighter who was called to the incident asked about Fernando, and commented on his suspicion that the driver was drunk. “Did the Porche guy leave? Did the family take it?”asked the rescuer. “Went to the hospital. The mother took it”the PM noted. “These guys were a little drunk, right?”pointed out the firefighter. “Yes yes”confirmed the other police officer.

SSP of São Paulo speaks out

In a statement, the São Paulo Public Security Secretariat declared that the police officers made a mistake by not taking the breathalyzer test. “The Military Police investigation concluded, based on the analysis of body camera images, that there were procedural failures by the police officers who responded to the incident, as they did not follow the PM’s orders and did not submit the driver to a blood alcohol test.”said the text.

The agency added that “a procedure was opened to hold police officers accountable. It is worth noting that, while waiting for the breathalyzer, it is the police officer’s duty to preserve the location and the suspects, in addition to calling the health service. Currently, the Traffic Policing Command (CPTran) has 150 breathalyzers for use in patrolling activities”.

This Thursday (25), the São Paulo Civil Police requested the arrest of driver Fernando Sastre for the 3rd time. The businessman will answer for the crimes of intentional homicide, injury and escape from the scene of the accident. His mother, Daniela, was also indicted for fleeing the scene of the accident, as a co-author.

The Military Police Internal Affairs is investigating the conduct of the two agents for failing to comply with the protocol for dealing with accidents involving victims. On the other hand, the Civil Police is investigating the causes and possible responsibilities for the death of the app driver and the serious injuries of Fernando’s friend, Marcus Vinicius Machado Rocha. He was in the passenger seat of the Porche and, in addition to his injuries, he fractured four ribs and had his spleen removed in surgery.
