The Rio de Janeiro court ordered the release of Érika Souza, the woman who took her deceased uncle in a wheelchair to withdraw a loan of R$17,000 at a bank branch in the West Zone of Rio.

This Wednesday (1st), the Public Ministry reported Érika Souza to court for the crimes of attempted embezzlement and vilification of a corpse, which is when a person treats a corpse with a lack of respect.

However, judge Luciana Mocco, head of the 2nd Criminal Court of Bangu, responded to a request from her niece’s defense and revoked the preventive detention.

In this way, Érika, who has been imprisoned since April 16, in a prison in Bangu, will respond to the case in freedom.

In her decision, the magistrate highlighted that Érika is a primary defendant, has a fixed residence and has poor mental health, having even been hospitalized due to chemical dependency on sedatives and hypnotics, in addition to having an underage daughter with deficiency.

“The accused is the mother of the minor Beatriz Nunes Marques, who has a disability with no defined etiology, according to a medical report by the Genetics Center of the Fernandes Figueira Institute, despite the declared psychomotor delay, as the preventive detention is being revoked. In view of the above, I revoke the preventive detention of the accused and replace it with precautionary measures.”

Érika must comply with precautionary measures such as monthly attendance at the court registry; presentation of a medical report if there is a need for hospitalization for mental health treatment; and she is prohibited from being absent from the district for more than seven days.

Recently, Érika also began to be investigated for manslaughter, when there is no intention to kill. The next phase for the police is to decide whether she will also be charged with this crime.
