The Government of Tocantins was ordered to pay compensation of R$100,000 to the family of a six-month-old baby who died at the Hospital Regional de Paraíso, in October 2018. According to the Court, the State did not provide the necessary support to the victim during the treatment.

The State informed the g1 that the Attorney General’s Office has not yet been notified of the decision.

The decision was signed by judge Wellington Magalhães, from the 1st District Court of Cristalândia, last Wednesday (24). According to the Court of Justice, the parents reported that the government did not provide the necessary equipment to restore the health of the baby, who was diagnosed with pneumonia and shortness of breath. They filed the lawsuit in 2020.

The child was first taken to the Lagoa da Confusa Hospital and then sent to the Paraíso Regional Hospital. At the time there was a request for transfer to the Palmas General Hospital, but the patient went into cardiorespiratory arrest in Paraíso and was taken to the emergency room, where she died.

In the action, the parents present a Nursing Evolution report stating that the emergency room “did not offer the necessary support”, as the equipment used in patients with respiratory failure was damaged.

The device is called an ambu. It has a mask connected by valves to a silicone balloon, which makes the air travel through the structure until it reaches the patient. Parents also reported that there was no equipment for x-ray examinations.

In the sentence, the judge states that the medical records proved the State’s omission during the victim’s cardiopulmonary resuscitation procedure, due to the lack of adequate ambu for a six-month-old child.

“Without carrying out the aforementioned procedure, the child did not even have the chance to be resuscitated with pediatric equipment appropriate to his age group, which led to the death proven in the records”, said the judge in the ruling.

The court established the compensation based on the damage caused to the baby and parents, due to the great emotional shock. The judge ordered the state to pay a fixed amount of R$100,000 to the victim’s family.
