The approval of the admissibility of the bill that allows states to legislate on weapons in the Constitution and Justice Commission was a personal victory for Santa Catarina deputy Carol de Toni (PL), president of the CCJ. She is the author of the proposal, which authorizes each state to define the possession and carrying of firearms for personal defense, sports and control of invasive species.

The score at the CCJ was tight, 34 votes to 30, and included intense internal negotiation. The deputy herself acknowledged in the justification of the bill that the Federal Supreme Court (STF) recently overturned state laws on the same topic, under the justification that the prerogative to legislate on weapons belongs to the Union.

In the end, the commission included a condition in the text: states that release weapons, if the project is approved, will have to establish an arms control model integrated into the National Public Security Information System, Sinesp.

The text will still have to pass through the plenary of the Chamber, where the clash promises to be tougher and promises to raise controversy, since there is an understanding that handing over deliberations on armaments policy to the states violates the Disarmament Statute. Deputy Patrus Ananias (PT-MG) presented a separate vote for unconstitutionality in the CCJ, pointing out what the understanding of the government’s basis will be.
