The Civil Police of Santa Catarina, with support from the Civil Police of Rio Grande do Sul, served two arrest warrants issued for the crime of child abuse resulting in death, on Wednesday (27).

The fugitives, the child’s mother and stepfather, claimed in the incident report with the Civil Police that the child had fallen hitting his head while he was with them in a shopping mall in the city of Florianópolis, but that he did not appear to be feeling ill, so , was taken to the hospital just one day after the incident, when she woke up feeling unwell. The child would have returned home and been sent to the hospital again only the following day, already unconscious. She was revived by medical staff, but ended up brain dead.

However, the expertise determined that the cause of the child’s death, which occurred on June 21, 2015, in Florianópolis, was due to “Shaken Baby Syndrome” (or Maltreated), which is defined as a vigorous shaking of the child’s body. child with exaggerated head shakes when the child would have been restrained by the extremities or shoulders.

As the medical report pointed out, such repeated and exaggerated movement of the child’s head can cause rupture of the cerebral and retinal vessels and generate an acute subdural hematoma, with a series of hemorrhages. The situation would have progressed to the death of the child, who was only 4 years old at the time of the incident.

The couple was convicted after a long criminal trial for child abuse resulting in death. During the process, several legal subterfuges were used to postpone the sentence, with the aim of evading justice.

Escape route

The victim’s mother and stepfather were under arrest orders due to the final and unappealable conviction, issued by the 1st Criminal Court of Florianópolis, after the return of the records from the higher courts. The process began in 2015 and both had been on the run since June 2023.

After becoming aware of the judicial arrest orders, the Captures Police Station carried out incessant investigative measures for two months and, thus, made it possible to obtain the whereabouts of the fugitives, who were in a house rented for the season in the city of Capão da Canoa, in Rio. Grande do Sul, where they were arrested by the civil police.

The fugitives had been living for almost a year in vacation rentals and hotels, in various tourist cities and beaches in Rio Grande do Sul and Santa Catarina, living a comfortable life and using false documents.

Use of false documents

During the arrest, the man presented a false driver’s license and a Santa Catarina Civil Police t-shirt and a Justice Officer’s functional card were seized from the fugitives.

The prisoners were taken to the 6th Police Station of Porto Alegre, where, after carrying out the procedures, they were also charged with the crime of using a false document. The two will remain at the disposal of the Judiciary of Rio Grande do Sul for a custody hearing.
