Robson de Souza, aka Robinho, completed a week at Penitentiary 2 in Tremembé (SP), this Thursday (28). Lawyer José Eduardo Alckmin told the g1 that the 40-year-old former player is well and living his daily life in prison, where he is serving a 9-year sentence for the gang rape committed against an Albanian woman in Italy in 2013.

Lawyer José Eduardo Alckmin explained to the reporting team that he had no contact with Robinho since his arrest. Information about the current situation in the penitentiary is passed on by the former player’s wife to the defense.

“[A família] is probably unhappy. It is a family formed many years ago with harmony, despite what happened […]. Of course he would rather be free and living his life. But, as far as possible, he is fine,” said the lawyer.

The former athlete will only be able to receive family visits after the Easter holiday. Since he was arrested, he has been isolated from the other inmates. This period ends after 10 days, that is, on Sunday (31).

He was placed alone in an 8m² cell for adaptation and necessary assessments by the prison team. The place consists of a bed, sink and Turkish basin — toilet built into the floor.

The hours before Robinho’s arrest:

  • Convicted: The Italian court, at first, tried to make the former player serve the 9-year sentence in the European country, but, because he was in Brazil, which does not extradite its citizens, the Italian government approved a request for the former -player was arrested on Brazilian soil.
  • Normal life: In the last two years, already convicted by the Italian courts, he remained free in Brazil, where he led a peaceful routine, including the beach, football and barbecue.
  • STJ decision: The ministers voted on three issues, on the 20th, to make the decision: conviction, regime and application. For all, they took into consideration the material gathered by the Italian Court, whose sentence was approved and validated by the superior court. They decided to sentence him to 9 years, in a closed regime and with immediate imprisonment.
  • Slept at home: Despite the decision calling for immediate arrest, some bureaucratic procedures needed to be taken and, at night, this was not possible. On the same day, however, the former player’s defense informed and filed a request for habeas corpus with the Federal Supreme Court (STF) to suspend the execution of the sentence while an appeal still remains.
  • In which house?: Robinho has 20 properties in Baixada Santista. Reporting teams chose to look for him in the two most frequented by the former player. A building in the Aparecida neighborhood, in Santos, and a mansion valued at R$10 million, in a gated community in Acapulco, in Guarujá. In both properties, lights are on and silence.
  • Harrowing morning: During the morning of the 21st there was a lot of talk about the arrest, but the STJ did not take the next step. This situation happened in the afternoon.
  • Arrest order: The president of the STJ Maria Thereza de Assis Moura signed the order for the Federal Court in Santos to carry out Robinho’s arrest at around 4am.
  • Federal Court of Santos: The document was received around 5 pm. The Player was on the roof of the building in Santos.
  • Arrest warrant: Judge Mateus Castelo Branco Firmino da Silva signed Robinho’s arrest warrant at around 6:30 pm.
  • Prison: Federal police officers arrived at Robinho’s building and left the place with the convict at around 8 pm. He was taken to the PF headquarters in Santos, in the city center.
  • Custody hearing: The former player was taken to the Federal Court building, a few meters away, where he underwent a custody hearing. The judge decided to maintain the prison.
  • Santos IML: Robinho was then taken to the IML in Santos, where he underwent a forensic examination. He remained there for just over 10 minutes and, from there, was taken to the Tremembé penitentiary complex, where he arrived in the early hours of the morning.

The day after the arrest, after the STF had rejected the request for habeas corpus de Robinho, lawyer José Eduardo Alckmin filed a regulatory appeal (type of appeal) to request that the rapporteur reconsider the decision or forward the case to the Plenary or the Panel.

The decision, however, must be made after Easter. As provided for in article 62, section II of Law 5,010/1966, which defines holidays in the Federal Court and in the higher courts, the STF does not have business hours from March 27th to 29th.

The lawyer explained to the g1 that Robinho will be imprisoned until the STF grants an injunction so that he can face trial in freedom. Alckmin, stated that he is confident that the situation will be reversed given three arguments presented by the defense:

  1. For the defense, Italy’s conviction should not be applied in Brazil;
  2. The lawyer stated that the international treaty does not provide for this transfer of sentence execution;
  3. Another basis used was that the migration law came into force in 2017. As the crime happened in 2013, Alckmin believes that this legislation should not be considered. “It’s retroactivity to harm,” he said.

The crime of collective sexual violence occurred in 2013, when Robinho was one of the main players at Milan, a club from Milan, Italy. Nine years after the case, on January 19, 2022, the court in that country ultimately sentenced him to serve the established sentence.

Robinho was convicted after having raped an Albanian woman together with five other men in a nightclub in Milan. The victim was unconscious due to heavy alcohol consumption. The convicts claim that the relationship was consensual.
