A 52-year-old farmer was arrested for illegal possession of a weapon in the city of Mathias Lobato, in the Rio Doce Valley, in Minas Gerais, this Tuesday (March 26). Two weapons were found on his property: a shotgun and a revolver. The last one was hidden inside a child’s shoe, according to the military.

The police were called to the location after receiving information from the intelligence service of the 6th Military Police Battalion (BPM) about the existence of weapons at the location. When they arrived at the farm, the police came across two men, who fled. As the house showed signs of a break-in, the police entered the residence.

At the house, police found the shotgun on top of a wardrobe in the couple’s bedroom. The revolver was hidden inside a child’s shoe, which was on the same piece of furniture.

As they left the scene, the police saw the farmer, who was arriving by car. He confessed to being the owner of the weapons and said he did not know the two men who were on the property and who fled. He was taken to the police station and could face charges of illegal possession of a weapon.

Illegal carrying or possession of a weapon?

You crimes of illegal possession of a firearm and illegal possession of a firearm are provided for in the Disarmament Statute. The law was published on December 22, 2003 by then president Luiz Inácio Lula da Silva (PT). Article 12 of the statute deals with gun possession.

The law determines the crime of illegal possession as “possessing or keeping under one’s custody a firearm, accessory or ammunition, of permitted use, in violation of legal or regulatory determination, within one’s residence or outbuildings, or even in one’s premises. workplace, as long as you are the owner or legal guardian of the establishment or company”. In other words, if the person does not have authorization to carry a weapon, but has it at home or at work, they will be liable for illegal possession of a firearm. The penalty for this crime is imprisonment for 1 to 3 years, in addition to a fine.

Article 14 of the Disarmament Statute deals with illegal possession. If the person has the weapon, buys, supplies, receives, stores, transports, gives, lends or hides a firearm or ammunition for permitted use, without authorization, he or she will be liable for this crime. The expected penalty is 2 to 4 years and a fine. In the case of illegal possession, the crime is non-bailable, except when the weapon is registered in the agent’s name.
