Rio’s Penal Police decide to maintain an operation to tighten visits to prisons, as a way of demanding adjustments

At the General Assembly of the category of Criminal Police of the State of Rio de Janeiro, the civil servants decided that they will maintain the Standard Operation for another week throughout the Fluminense Penitentiary System. The protest movement has been going on for a month. The category demands the forwarding of the Jobs, Careers and Salary Plan (PCCS) and the salary recovery of state employees and sees, in the movement, a way of opening dialogue with the government, which has not negotiated with the category for months.

The approach to visitors at the entrance to penitentiary complexes is structured in “strict compliance with the law”, based on the constitutional principles of human dignity and legality, as well as the protection of the physical, moral and psychological integrity of citizens in contact with the prison system, as determined by law.

“The operation ‘within the law, be carried out, without improvisation’ does not intend to restrict the rights of any visitor. the movement will be carried out progressively, as a demand for compliance with the rights of criminal police officers who have been disrespected by the government, as well as , meeting essential demands”, highlights the Union of Criminal Police Officers of the State of Rio de Janeiro.

A distant dream

At the end of January, the Attorney General’s Office of the State of Rio de Janeiro (PGE) gave an opinion against the continued implementation of the Criminal Police PCCS. Legal unfeasibility was pointed out due to the existence of unconstitutionality defects in the law that establishes the plan for employees. The legislation is complementary to the Organic Law of the Criminal Police.

The PGE then determined that the process should return to the originating body to “compliance with the guidelines outlined and relevant modifications”.

The Union of Criminal Police Officers of the State of Rio de Janeiro (Sind-Sistema) demands solutions so that the process is not paralyzed. The servers’ biggest concern at this moment is that all of the category’s efforts will be shelved.

“We understand that this expedient used by PGE is a maneuver to delay the process, considering that the constitutional basis of the project is Constitutional Amendment No. 104, of 2019”, highlights the entity, in a note.

The Penitentiary Administration Secretariat highlights that “the process relating to the PCCS has not been returned to SEAP, and is still at the State Attorney General’s Office (Social Security Attorney’s Office), following a statement from the Chief Attorney of the Personnel Attorney’s Office.”

Nothing yet

The analysis of the PCCS of the Rio Penal Police by the PGE has already lasted three months. Since then, the process has not returned. Today, he is at PG7, a division of PGE that deals with social security matters.

The state government’s initial forecast is that the PCCS would be implemented between September and October of last year. The draft began in March 2023.

It’s guaranteed?

If it is actually handed over to the head of the Rio de Janeiro Executive, it is up to Cláudio Castro to approve the proposal or not. The PCCS project has undergone development in recent months, with the participation of representatives from Seap, the criminal police union and legal experts.

The approval of the PCCS is seen as very important for the category, as it ratifies the new police career, with entry at the 3rd degree level, and regulates the positions and salaries of the class.
