Senate CCJ approves new mandatory insurance for vehicles

The Constitution and Justice Committee (CCJ) of the Senate approved this Tuesday (7), by 15 votes in favor against 11, the complementary bill that recreates mandatory insurance for vehicle owners, the old Dpvat (Personal Injury for Vehicles Land Motor Vehicles). According to the rapporteur of the matter, Senator Jacques Wagner (PT-BA), the value of the new insurance is around R$50 and R$60 per year, with no difference between motorcycles and vehicles, according to calculations by the Ministry of Finance.

“Note that when it was in the insurance holding company, supported by the four large insurance companies that took care of the Dpvat until they declined, the value was more than R$100 [para carro] and more than R$200 for the motorcycle. Therefore, there was an absurd amount of fat”, argued Jacques Wagner, adding that as the insurance management will be handled by Caixa Econômica Federal, the value will be reduced.

The insurance is used to compensate victims of traffic accidents, in addition to financing the Unified Health System (SUS) and education and accident prevention actions through the National Traffic Secretariat. The new insurance should now be called Mandatory Insurance for the Protection of Victims of Traffic Accidents (Spvat).

Part of the opposition criticized the proposal, claiming that it is yet another expense to be paid by vehicle owners. Senator Carlos Vianna (Podemos-MG) proposed that only those who do not have private insurance should be required to pay for mandatory insurance.

“I, for example, have a family car, my daughter drives it. [O veículo] There is already insurance for this, I already pay for this insurance. Why are you obliged to pay Dpvat? Why do we have to impose this on the entire Brazilian society? Let’s create insurance just for those who don’t have it”, criticized the senator.

Senator Fabiano Contarato (PT-ES), in turn, argued that the insurance is of a solidarity nature, so that all vehicle owners help pay the costs of traffic accidents.

“It is only paid by those who own a motor vehicle, while anyone can be its beneficiary. Hence the function of social protection. If you run over someone and you don’t even know who the driver is, you need to receive insurance”, explained Contarato, adding that “it’s these people who don’t have the money to pay absolutely anything and who need this insurance”.

Senator Carlos Portinho (PL-RJ) criticized the return of insurance, justifying that it would be a new tax to increase federal revenue. “This will be the fourth, at least that I remember, vote in which we are giving the government the possibility of collecting more, increasing the tax burden”, he highlighted.

Senator Jaques Wagner denied that the intention of the project is to raise money for the government, but to serve the population affected by car accidents, who still seek the service. “Even after [o seguro ter] ended in 2021, by 2023 780 thousand people searched [o Dpvat]”, he justified.

The project being voted on, in addition to creating mandatory insurance, has been used as a negotiating currency between the Executive and the Legislative to compensate for the presidential veto that removed RS 5.6 billion in parliamentary amendments from this year’s budget, since the negotiation For approval of the project, it is expected that R$3.6 billion from the mandatory insurance collection will be used to pay R$2.4 billion in amendments from deputies and R$1.2 billion from senators. The project received an amendment in the Chamber that allows the Union’s expenses to be increased by R$15.7 billion this year.

Veto

Rapporteur Jacques Wagner denied highlights of the opposition to the matter, guaranteeing that President Luiz Inácio Lula da Silva committed to vetoing the article that creates a fine for late payment of the new insurance, as requested by senators Alan Rick (União-AC) and Vanderlan Cardoso (PSD-GO).

“I am committing myself here to the senators and to the commission that this item, which is an excessive penalty, which came from the Chamber, will be vetoed by the President of the Republic”, he stated.

Created in 1974, Dpvat was mandatory insurance designed to compensate victims of traffic accidents throughout the national territory. The compensation was paid in cases of death, total or partial permanent disability and for reimbursement of medical and hospital expenses from the private network for physical damage caused by accidents with land-based motor vehicles or their loads.

The charge was extinguished in 2021, when Caixa Econômica Federal took over the management of Dpvat resources and payments in place of Seguradora Líder, which was a consortium of private companies. At the time, there was a surplus of around R$4.3 billion, which allowed insurance payments to victims of traffic accidents to be maintained.

However, payment of compensation was suspended in November last year, due to lack of balance in the Dpvat fund. Now, with the approval of the project, mandatory annual insurance will once again be charged to vehicle owners and will continue to be operated by Caixa Econômica Federal.
