Released last Monday (25), Daniel Alves will be on provisional release until the judgment of the appeals in the sexual assault case in Barcelona, ​​in 2022. In conversation with the Throw!Brazilian lawyer Lucas Wenzel, who works in Spain, spoke about the former player’s estimated time out of prison.

“There is currently no forecast for the judgment of the appeals, but it is estimated that Daniel Alves will spend one or two years in freedom, which is how long it is estimated that it will take to reach a final decision, based on similar cases. The appeals will now to the Superior Court of Justice of Catalonia and then the decision can still be appealed to the Supreme Court”, he commented.

Daniel Alves paid bail of around R$5.4 million and will have to comply with some rules, such as not leaving the country, keeping a distance of at least 1km from the victim and appearing every Friday at the Barcelona Court. Wenzel commented on how the former player’s freedom was received by lawyers in Spain.

“The Spanish legal profession here is a little divided. They consider that yes, in similar cases, it would be normal for provisional freedom to be granted, since only someone is considered guilty after the final judgment has been reached. However, many point out that there really is a very high risk greater chance of escape given the athlete’s economic conditions”.

The Spanish Public Prosecutor’s Office appealed the provisional release decision, citing the former player’s risk of flight. Last Tuesday (26), Daniel Alves had a party at home to celebrate his father’s birthday, with friends and family. Wenzel ended by commenting on the possibility of changing the former athlete’s sentence.

“Both the Public Prosecutor’s Office and the victim’s lawyer request that the sentence be increased considering that they consider that the mitigating factor for the payment of compensation should not be applied. Daniel Alves’ defense seeks acquittal, considering that there was consent. Here it is necessary say that everything happens”, concluded the founder of the law firm Stargaze Holding.
