Moraes makes decision on Bolsonaro’s visit to the Hungarian embassy

Minister Alexandre de Moraes, of the Federal Supreme Court (STF), filed the representation against former president Jair Bolsonaro (PL) who alleged that the former president had violated the precautionary measures imposed in the investigation investigating an alleged attempted coup d’état , while staying at the Hungarian Embassy for two days in February.

Bolsonaro’s stay at the embassy building was published by The New York Times, with images from the internal security circuit. The defense claims that the former president was invited to stay, and had conversations with numerous authorities to update the political scenarios of the two nations.

The American newspaper suggested that the former president was trying to take advantage of his friendship with Hungarian Prime Minister Viktor Orbán in an attempt to avoid the Brazilian judicial system. Four days before arriving at the embassy building in Brasília, Bolsonaro was the target of Operation Tempus Veritatis, by the Federal Police, on February 8.

According to Moraes, it was not possible to “discern” the precautionary measures imposed in the investigation, since the land of an embassy is protected by diplomatic conventions, but is not foreign territory.

“The locations of diplomatic missions, although they have special protection, under the terms of art. 22 of the Vienna Convention on Diplomatic Relations, promulgated through Decree No. 56,435/1965, are not considered an extension of foreign territory, which is why, in this case, no violation of the precautionary measure of ‘prohibition on leaving the country’ is envisaged. ”, wrote Moraes.

The judge also understood that there are no concrete elements that indicate an attempt at diplomatic asylum to escape the country and harm the criminal investigation. Moraes also stated that there is no need to change the precautionary measures that were determined at the beginning of February.

By order of the magistrate, Bolsonaro is prohibited from leaving Brazil and his passport was seized. On more than one occasion, the former president’s defense calls for the measures to be suspended so that he can travel again, having been invited, for example, to visit Israel.
