“There is no surprise for us, there was already a consensus within the Forces, it was already pacified”, said the commander to the blog.

According to him, the constitutional text, in the Army’s assessment, “is very clear in defining the functions of the Armed Forces”.

“The text is very clear, they are subordinate to the Minister of Defense and, mainly, to the President of the Republic”, stated the general.

The majority of STF ministers understand that the Armed Forces are not a “moderating power”

Tomás Paiva recalled that the risk of debating a moderating power was created – referring to the period of the Bolsonaro government. But, according to the general, this hypothesis “never guided our thinking”, which was always about obedience to civil power.

According to the general, the function of moderating power was present in the Constitution of the empire, but later, in the others, “it was never registered again, it is an issue that has been pacified and completely overcome for us”.

The STF has already formed a majority to consider that the Brazilian constitutional regime does not provide for a military power, but only a civil power, with the Armed Forces subordinate to the President of the Republic. The score is now 7-0.
