The first instance conviction was upheld and a former director of public services will have to pay R$3,000 to a driver injured by him while working at the city hall of Xaxim, in western Santa Catarina. The collegiate decision was taken by the 1st Chamber of Public Law of the Court of Justice (TJSC).

According to the lawsuit, the two worked together and due to a disagreement, the then director attacked the subordinate with a machete.

During the hearings, witnesses gave different versions of the case: the defendant claimed that he retaliated after being punched and also said that the blow occurred in the middle of an argument.

Due to the fact that the violence took place within the municipality’s Infrastructure Department, the victim asked the city hall for condemnation for aesthetic and material damage, which was denied in both instances.

The Justice also readjusted the amount of compensation requested by the driver, of R$ 300 thousand. The final amount was fixed at R$ 3 thousand, plus interest and monetary restatement.

“However, it appears that, although the facts took place in the premises of the city’s machine garage, it is a private disagreement between the author and the victim, so that no guilt of the public entity over the facts has been proven, whether due to imprudence or negligence, especially considering that both those involved were municipal civil servants”, the judge rapporteur Luiz Fernando Boller noted in the vote.
