Less than 24 hours after having his mandate revoked by the City Council, the vice-mayor of Formoso do Araguaia, Israel Borges Nunes (Republicans), obtained an injunction to return to office. The decision does not apply to the mayor, who also lost his mandate.
In the same legislative session that revoked the two mandates, the president of the City Council, Felipe Souza Oliveira (PRTB), took over as mayor of the city.
On Tuesday (7), Israel Borges appealed to the 1st Civil Registry of Formoso do Araguaia in an annulment action with a request for an injunction. He argued that he officially did not replace the mayor at any time during his term, and did not commit a political-administrative infraction that could justify his impeachment.
The request was accepted by judge Valdemir Braga de Aquino Mendonça.
“In view of this, the necessary requirements for granting guardianship were present, hence why I grant the injunction and suspend the effects of Legislative Decree No. 002/2024 of the municipality of Formoso do Araguaia exclusively in relation to vice-mayor Israel Borges Nunes, author of this demand. Consequently, I order his immediate reappointment to the position”, says the decision.
The decision can still be appealed, but with his return to office, Israel Borges should become the city’s mayor. O g1 asked the municipality if he had already taken over as mayor, but there was no response until the publication of this report.
The impeachment request arose from evidence investigated by the Federal Police during Operation Rota Dubai, which investigates misappropriation of resources from the National School Transport Support Program.
The extraordinary session for the impeachment was held on Monday night (6). The vote was 10 x 1, in favor of the impeachment of both.
