Regularize Capixaba will allow debtors enrolled in active debt to make an agreement to pay debts with the State

Taxpayers who are in active debt with the Espírito Santo government have a new opportunity to negotiate their debts and regularize their tax situation. Negotiations can be done directly at the State Attorney General’s Office (PGE), using the Regularize Capixaba program, launched this Tuesday (7).

There are two ways for negative people to achieve regularization. One of them, which is permanent in the program, occurs through an individual agreement aimed at debts registered in active debt above R$1 million.

There is yet another way to regularize with the help of Regularize Capixaba, through notices divided by themes. And the first theme chosen by the program will benefit companies that were fined for omission of revenue, ascertained by the divergence of data reported by credit and debit card administrators and those passed on by taxpayers to the Tax Authorities.

The measure comes after the approval, last year, of a tax transaction law that aimed to expand negotiation instruments, allowing new pacts for debtors who have debts registered as active debt with the State. The explanation was given by the State Attorney General, Jasson Hibner, who participated in the launch of the program before leaving office for personal reasons and giving way to Iuri Carlyle.

“When the taxpayer is not negative, he has more access to credit, he can invest more and these investments generate income, employment and distribution of wealth for society. So, the objective is to create instruments that are more flexible to allow the State to collect more without increase the tax burden”, details the attorney general.

Discount and deadline

In the case of the adhesion notice, the attorney general highlights that the first focuses on Simples Nacional companies that have been fined by the State Department of Finance (Sefaz) for discrepancies in accounting writing for receipts by credit and debit card.

In this case, membership of the modality can be made from June 3rd to July 31st. Currently, there are 3,600 fines of this type that can be resolved through this negotiation.

For payment in cash, companies will have a 100% discount on late payment interest and 60% on fines and other charges. For payment in up to 120 installments, 90% discount on late payment interest and 50% on fines and other charges.

“This type of debt was chosen because it is one of the highest volume in the State and because we are still experiencing a post-pandemic scenario in which small companies that opt ​​for Simples Nacional are still recovering”, details Jasson.

For the next notices, the regularization of IPVA debts and also other ongoing legal actions that discuss the monetary update index may be included. But this schedule is yet to be defined.

According to Amaral, with the first payment of 5% of the debt, the taxpayer will already be tax regular. However, if you fail to comply with the agreement – ​​failing to pay the installments – the debt will return with all interest and charges. And the defaulter will also be unable to make a new agreement for two years.

Regularize Capixaba is an instrument signed between the taxpayer and the tax administration, through which, through mutual concessions, the aim is to extinguish debts registered in Active Debt by the State, taking into account the particularities and financial situation of the taxpayers or the own debt.

Requests to negotiate must be made through the State’s electronic process system, e-Docs, and directed to the PGE Tax Transaction Center. The program will cover the resolution and preventive transaction of disputes relating to the collection of credits from the State of Espírito Santo in Active Debt, of a tax and non-tax nature.
