According to criminal experts, Pedro Domiense Campos had “sufficient opportunity, time and space to carry out the evasive maneuver that would allow the railway line to be cleared in the face of the approaching train”.
The driver’s defense was not located. The bus company did not comment until the publication of this report.
The accident took place on November 17, 2023, at around 4:30 pm. A person in a car filmed the moment of the crash. (see video above). Five people were injured and a passenger on the Viação Marechal bus died (learn more below).
The driver was charged with manslaughter — when there is no intention to kill — and for bodily injury. The conclusion of the PCDF investigation will be forwarded to the Court of Justice of the Federal District and Territories (TJDFT) for analysis by the judge.
‘Conditions in the traffic flow allowed maneuvering ahead’ says expert
According to the survey results, “the determining cause of the accident was the behavior of the bus driver, who disregarded the mandatory stop signs when entering the railway line in order to obstruct the path of the train, which had priority passage“.
Criminal experts also analyzed the signage and concluded that in passive signage there are no gates or other mobile devices, but there is vertical signage. Already horizontal signage did not meet the principles of visibility and legibility, maintenance and conservation.
The conclusion of the survey also points out that 12 seconds before the collision with the train“the conditions in the flow of vehicles allowed the bus driver to perform an evasive maneuver ahead”. Furthermore, experts conclude that there was the possibility of opening the bus doors with command action for passengers and conductor to exit the vehicle, avoiding victims in the accident.
