Complaints were presented at the Public Transport CPI in 2021

The 14th Public Prosecutor’s Office of the District of Blumenau issued an opinion on the transfers made by Blumenau City Hall to Blumob, the concessionaire responsible for urban transport in the city, during the period impacted by the coronavirus pandemic. The decision excludes the possibility of any irregularity and, as a result, the MPSC archived the process.

The complaints were presented by councilor Carlos Wagner, in 2021, with the Blumenau Public Transport CPI, to investigate possible irregularities in the city’s collective public transport concession contract. At the time, the members of the commission concluded that there was no proof of the alleged irregularities presented by the councilor. Parallel to the CPI, the councilor forwarded the complaints to the TCE-SC and the Public Ministry of Santa Catarina (MPSC).

In the case of the Public Ministry, the opinion, signed by prosecutor Marcionei Mendes, addressed not only the investigation of possible irregularities in the Competition Bidding Process 38/2016 and the execution of Contract 042/2017 between the municipality and Blumob, but also issues related to the control, regulation and inspection by the Intermunicipal Public Services Regulation Agency (Agir).

Civil inquiry

The civil investigation was closed by the Public Prosecutor’s Office because it did not find evidence of administrative improbity, damage to the treasury, illicit enrichment or other actions harmful to the public administration as alleged in the complaint. The MPSC also considered the complaint about the alleged lack of control, regulation and supervision by Agir to be unfounded.

SMTT secretary, Alexandro Fernandes, highlights that “the result of the opinion shows that both the complaint and the CPI were unnecessary”.

For Mayor Mário Hildebrandt, archiving the process is the certainty that the right thing is being done by management. “Keeping public transport operating has become a challenge for all cities after the pandemic and the transfers are a guarantee that citizens will not be left without the service. Maintaining and providing conditions for public transport is the municipality’s duty and in Blumenau this is fulfilled and is completely within the legislation”, he reiterates.

The same complaint was also sent to the State Audit Court (TCE-SC). The process remains ongoing, but the opinion also points to archiving.
