Government suffers defeat in the Senate and voting on the new DPVAT will need to go through committee | Policy

The federal government suffered a defeat in the Federal Senate plenary after trying to approve a request to speed up the analysis of the project that recreates mandatory insurance for victims of traffic accidents, known as DPVATthis Tuesday (23).

The government’s idea was to skip steps in processing the proposal and take the issue directly to the Senate plenary, made up of a majority of pro-government senators.

The project has already been accelerated and is being processed directly by the Senate’s Constitution, Justice and Citizenship Committee (CCJ), without having gone through other committees before. The project is expected to be voted on this Wednesday (24), as the first item.

For a direct vote in the plenary, the government would need a simple majority. This afternoon, 64 senators were present, including all eight from the PT. Among the 17 absentees, the majority were in opposition.

After the urgency request was read by President Rodrigo Pacheco (PSD-MG), Opposition leaders were against the possibility of voting on the request in the plenary without it first being considered by the CCJ.

Among the arguments used to not speed up the text is the inclusion of a topic unrelated to the original subject of the proposal, which is called “jabuti” in Congressional jargon.

Still during discussion in the Chamber of Deputies, the proposal incorporated an article that allows the analysis of federal government revenues to be brought forward from the second to the first two months of this year (understand more below).

“We haven’t even had the opportunity to look into this issue in the Constitution and Justice Committee of the Senate of the Republic and we are reintroducing an extremely regressive insurance policy that penalizes the poorest, at the same time carrying out yet another kind of amputation, sorry , an addition to the infamous fiscal framework”, stated the opposition leader, Rogério Marinho (PL-RN).

After agreement with the government leader, Jaques Wagner (PT-BA), parliamentarians reached an agreement for the request to be removed from the agenda, awaiting a vote in the CCJ this Wednesday.

Chamber approves return of DPVAT, mandatory vehicle insurance

It will function as mandatory insurance for compensation for damage caused by vehicles or their cargo and must be paid by all vehicle owners.

Among the justifications, the government stated that “after practically three years of mandatory insurance operating under an emergency and transitional regime, it is necessary to establish new legal bases to provide permanent, sustainable and adequate insurance for traffic victims”.

The main point of interest for drivers has not yet been defined: the amount to be charged for insurance will be established after the project is approved by Congress.

The new insurance coverage will generate compensation for:

  • death;
  • permanent, total or partial disability; It is
  • reimbursement of expenses for medical care, funeral services and professional rehabilitation of victims who may have developed partial disability.

Insurance will be paid to everyone who provides proof of the accident and the damage it caused, regardless of whether it was caused intentionally or unintentionally.

The compensation amounts will be established by the National Private Insurance Council. The fund will continue to be managed by Caixa.

The text also provides that between 35% and 40% of the amount collected by the fund will be transferred to municipalities and states where there is a municipal or metropolitan public transport service.

Revenue expansion assessment

The “jabuti” included by the Chamber in the project will allow the government to anticipate the execution of extra expenses to the Budget.

According to the rules of the fiscal framework, approved last year, the government will only be able to make these extra expenses if an increase in revenue is verified – in relation to what was initially foreseen in the year’s accounts – in the Budget evaluation report for the second two months. This report will be released on May 22.

The change in the framework was poorly evaluated by the opposition.

“By law, a foreign matter cannot be included [ao projeto], even more so this way. If a complementary law is needed to change the framework, make a complementary law. But in the middle of a DPVAT discussion, a totally strange topic comes up, it doesn’t make sense”, said deputy Marcel Van Hattem (Novo-RS) at the time of approval.
