Companies with debts from the Tax on Circulation of Goods and Services (ICMS) will be able to negotiate the debts with the State Secretariat of Finance of Minas Gerais (SEF/MG) under special conditions. With an adherence period between 1/4 and 21/6, the tax debt regularization program, entitled Refis ICMS MG 2024, was published this Wednesday (27/3) by the Government of Minas, in the Official State Gazette. The program rules are set out in Decree 48,790.

Refis provides for the payment of debts with reductions in fines and interest ranging from 30% for payment in 120 installments to 90%, in the case of payment in cash.

For the Government of Minas, the program represents another opportunity for companies to reorganize themselves financially and honor their commitments to the Tax Authorities.

“It’s not about benefiting bad tax payers. There can be several reasons for default. Those taxpayers who want to regularize have an excellent chance. We had already launched a Refis in 2021, with the aim of helping companies that were harmed by covid-19 pandemic. Now, with the pandemic crisis over, we are betting on boosting the state’s economy”, assesses the Undersecretary of State Revenue, Osvaldo Scavazza.

ICMS debts that are open or in installments, registered or not in active debt, whether or not their collection has been filed or not, relating to triggering events (such as due dates, operations carried out or invoices issued) occurring up to 3/31, 2023, can be reached by Refis. To join the program, the taxpayer must consolidate all outstanding debts. Even companies that missed previous installments will be able to join again. The value of the installment cannot be less than R$500.

Form of membership

To join Refis, the taxpayer must fill out the application in the Integrated State Revenue Administration System (Siare), available on the State Department of Finance website. Alternatively, the request may be submitted to the Tax Administration (AF) in the taxpayer’s district or at the External Taxpayer Centers (NConext) located in the cities of Rio de Janeiro, São Paulo or Brasília.
