Influencer Rebeca Aguiar is being accused of parental alienation by lawyer Weverton Matias after moving from Rio Branco to Minas Gerais (MG) with the ex-couple’s son. Matias recorded a video and posted it on social media stating that he was not informed by his ex-wife about the seven-year-old child going to another state permanently.

A parental alienation is understood by Brazilian law as a form of emotional abuse of children and adolescents during separation processes. The law defines parental alienation as the “interference in psychological training” of the child or adolescent with the aim of damaging the bond with the father or mother and producing repudiation against one of them.

The following are understood as alienation:

  • make it difficult for children to have contact with their father/mother or visitation rights;
  • “carry out a campaign to disqualify the conduct” of one of the parents in the exercise of paternity/maternity;
  • “deliberately omitting relevant personal information” about children;
  • “moving residence to a distant location, without justification”;
  • “filing a false complaint” against one of the parents to “make coexistence difficult”.

Matias and Rebeca separated more than seven years ago and share custody of their son. On the 15th, the lawyer says he looked for the influencer to stay with his son and found out that they were both traveling.

The conversation took place through a messaging application. Surprised, Matias questioned his ex-wife about why he hadn’t been informed about his son’s trip and Rebeca stated that she tried to talk to the lawyer and his mother, however, there was no response.

The lawyer disputed the accusation and highlighted that he needed to be informed when his son left the state. “It’s not that his mother went away and the child didn’t say goodbye. From what his mother is saying and from what the child told me, she left and communicated as if she had already left and had already adjusted with me. She left without talking to me, without the child saying goodbye, without giving the child the right to connect with cousins, with relatives. My son is the only grandson of my father, my mother, he was my grandfather’s first great-grandchild, and she did this,” he lamented.

Still in the video, Matias says he filed a police report to protect himself against his ex. “For a long time now we have been letting it go, putting ourselves in the position of giving in, of giving in and, over these years, there have been several police reports, several procedures at the Public Prosecutor’s Office, at the Guardianship Council, situations that the people reported it in a judicial manner. Many police reports, including to prevent, to protect themselves from any other situation, I had to make another police report and I hope that the Court can act”, he added.

Mother reported to the court

To the g1, Rebeca’s lawyer, Emerson Costa, states that the client contacted her son’s father informing him that she needed to talk to him personally ‘because the matter was serious’. However, Matias refused to talk in person and asked his ex-wife to speak on the phone.

Still according to the defense, without escaping her responsibilities, the influencer notified the authorities, filed a lawsuit and informed the court of the 3rd Family Court. Rebeca even attached updated proof of address.

“The child remained in contact via telephone with his father, protecting his rights. Understand, a father who goes on social media and informs that he is open to conversation, is not the same one who refuses to talk to his mother. Custody is shared, but the residence is fixed by the mother, so she did not fail to comply or run away, she informed the Court and followed the legal procedures”, highlighted the defense.

Emerson Costa also added that the client has always based her life on unconditionally caring for her son and finds the exposure made by her professional colleague unnecessary, as conflicts are discussed in secret judicial processes with analysis by qualified professionals.

“Parental alienation does not exist, including the child [do ex-casal] does psychological counseling and when one of the professionals wanted Mathias to participate in the session, he didn’t show up”, he argued.

Still in the video, Weverton Matias says that he had enrolled his son in jiu-jitsu, a sport he practices, three days before moving to another city and the day he proposed picking up his son would be the boy’s second class. He even says that he had bought the clothing used in the sport and was looking forward to his son’s development.

“I had already been talking about it and on March 12th I enrolled him, we bought the kimono, it was cool, it was his first class, he met new people, he had that first experience on the mat. It was a very happy night”, he recalled .

The lawyer also claims that there was always resistance from his ex-wife to have access to the son. “This is not new, it is something that both my family and I have been subjected to practically since he was born, with rare fluctuations from this pattern to something normal. It has always created this scenario, as if José were hers and his family, itself , it’s just her family, trying to subject me to the position of a mere pension payer”, he accused.

The father also highlighted that he would have no objection to his son going to live in another state, as long as this was agreed and everything was agreed with him beforehand.

“The problem is not that he changes, but the way she chose to do it. Silence in the face of all this would be compatible with agreeing to be “erased” from my son’s memories. I don’t want problems, nor do I want to be in an endless conflictual relationship On the contrary, I want to resolve it while valuing his well-being”, he concluded.
