This Tuesday (7), the Constitution and Justice Committee (CCJ) of the Senate approved the Bill that aims to recreate mandatory insurance for car owners, currently known as DPVAT (Personal Injury by Land Motor Vehicles), from 2025.

One of the changes is the change of the name of the insurance to Compulsory Insurance for the Protection of Victims of Traffic Accidents (SPVAT). Furthermore, the project proposes that there should no longer be a distinction between motorcycles and cars when calculating the insurance value.

The estimate is that the value of the new insurance will be between R$50 and R$60 per year, as calculated by the Ministry of Finance. The change represents a reduction in relation to the amounts previously charged by DPVAT, which could exceed R$100 for cars and R$200 for motorcycles, under the management of the Líder group.

And this is another one of the changes. is that now the insurance will become the responsibility of Caixa Econômica Federal, with the aim of improving the administration of the process.

Compensation and coverage

In the Chamber, the SPVAT recreation text was amended to expand the list of expenses covered by insurance. It now includes medical and supplementary assistance, funeral services, professional rehabilitation expenses for partially disabled victims, and allows compensation claims and document signing by electronic means.

The text also establishes that the victims’ spouses and heirs must receive compensation for death and reimbursement for funeral service expenses, while the victim will receive other coverage, such as permanent disability and reimbursement for medical and rehabilitation expenses.

Making payment easier

States will have the option of facilitating the payment of insurance for drivers, to be done together with the annual licensing or IPVA, thus seeking to make the payment process more accessible and ensure that the SPVAT is paid.

And in an attempt to encourage state governments to opt for this approach, 1% of the total collected annually through insurance will be offered to each federative unit.

In a gesture of commitment, Senator Jaques Wagner, rapporteur of the matter, stated that the president will veto certain sections of the proposal that establish fines for those who do not pay the insurance. This is to ensure that the text does not need to go back a phase and undergo further revisions in the Chamber of Deputies, where it was already approved in April this year.

The project also classifies non-payment as a serious infraction.

Destination of the collection

As foreseen in the project, 40% of the resources raised by SPVAT will be allocated to the SUS. But this allocation will not be mandatory, which may generate future discussions about the use of resources.

If approved in the plenary and sanctioned by President Lula, the new mandatory insurance model will come into force from 2025. This measure is a response to the end of the DPVAT in 2019, after the Federal Audit Court (TCU) discovered irregularities and excesses in compensation.

The proposal was approved with 15 votes in favor and 11 against in the Senate CCJ and now goes to the plenary for a vote.
