Bonuses for judges do not affect accounts, says Pacheco; technicians estimate R$ 82 billion

This Tuesday (23), the president of the Senate, Rodrigo Pacheco (PSD-MG), once again defended the proposed amendment to the Constitution (PEC) 63/2013, which he recreates for members of the Judiciary and the Public Ministry (MP) the so-called “five-year period”, an additional equivalent to 5% of the basic salary paid every five years. According to Pacheco, the bonus for magistrates does not affect “the balance of public accounts”.

Despite defending the bonus, the president of the Senate, who is also the author of the proposal, admitted the possibility of negotiation on the number of categories that will be entitled to the five-year period, since the PEC rapporteur, senator Eduardo Gomes ( PL-GO), extended the bonus to other categories, such as members of the Attorney General’s Office (AGU), the Public Defender’s Office and delegates from the Federal Police. The bonus was extinguished in 2003.

“The Budget belongs to the Judiciary, which will apply for this structuring. Our project of zero deficit, of balancing public accounts, is not affected by the prioritization, within the scope of an already defined budget, of career structuring, instead of the construction of forum buildings, for example. It is something that has been studied for many years. The expansion (of categories) deserves new studies, involving the Executive”, stated Pacheco.

The text of the PEC was approved last week by the Constitution, Justice and Citizenship Committee (CCJ) of the Federal Senate.

According to calculations by the Senate Budget, Inspection and Control Consultancy, the PEC will have a fiscal impact of at least R$81.6 billion by 2026.

In a technical note, the consultancy says that the impact would be R$25.8 billion this year “if [a PEC] had been in force throughout the year”; R$27.2 billion in 2025; and R$28.6 billion in 2026. The calculations take into account the text approved by the CCJ.
