SP prosecutor requests breach of confidentiality in the Porsche case – 04/23/2024 – Daily

Prosecutor Monique Ratton filed a series of requests to the Court in the investigation into the death of app driver Ornaldo da Silva Viana, 52, who was hit by the Porsche driven by businessman Fernando Sastre de Andrade Filho, 24.

Ratton requested the declassification of credit card data on Sastre’s behalf. According to the prosecutor, the measure is essential to clarify the payment for alcoholic drinks possibly consumed by the person being investigated and his group of friends moments before the collision.

Furthermore, the prosecutor argues that the data breach should be extended to third parties if the cards used to pay off the bar bill belong to other people. The Public Ministry of São Paulo also requested images from the body cameras of the military police officers who took part in the incident, as well as the IC (Institute of Criminalistics) carrying out the examination using a digital scanner and simulated reproduction of the facts in 3D.

Witnesses and bar attendants from where those involved left were also requested to be interviewed. The case is under judicial secrecy, imposed after Sastre’s defense argued that he was being targeted by threats as a result of the case.

This Tuesday (23), the forensic report was released showing that the driver of the Porsche was traveling at 156 km/h moments before the collision. According to the SSP (Public Security Secretariat), it also stated that, after an investigation, it concluded that there was a procedural failure on the part of the police officers who responded to the incident due to the driver not being subjected to a breathalyzer.

The crash happened in the early hours of the 31st on a road in the east of São Paulo. Fernando Sastre de Andrade Filho’s Porsche crashed into the car of app driver Ornaldo da Silva Viana, 52.

Sastre lost control of the Porsche and collided with the back of a Renault Sandero, according to military police officers who responded to the incident. Struck, Viana was rescued and taken to Tatuapé Municipal Hospital, where he died.

The businessman was indicted on suspicion of intentional homicide, bodily harm and leaving the scene of an accident. The owner of the Porsche presented himself at the police station on Monday afternoon, more than 30 hours after the collision.

The Public Ministry claims that Daniela Cristina de Medeiros Andrade, mother of the businessman who caused the accident, tried to hinder the investigations.

According to the Civil Police, the driver of the Porsche was taken from the scene of the accident in his mother’s car under the allegation that he would be treated at São Luiz hospital. As a result, the military police officers who responded to the incident did not administer the breathalyzer test.

The conduct of the Porsche owner’s mother was also taken into consideration for the arrest request, according to the delegate handling the case.

The Secretary of Public Security of São Paulo, Guilherme Derrite, told the PM that he is investigating whether there was an error on the part of the military police in allowing him to be helped by his mother. The Civil Police went to court to ask the agents to hand over the images from the body cameras they were using at the time of the incident.

Witnesses in the case were interviewed, such as Sastre’s girlfriend and the friend who was with him in the car and the girlfriend of the friend who was with him the night before the accident. While the businessman’s girlfriend denies that he had been drinking, his friends claim that they all drank hours before the accident.

A Sheet had access to the investigation with information about where the businessman’s group was before the accident — they went to dinner and then went to a poker house.

In one of the establishments, they consumed eight drinks called Jack Pork —made with whiskey, liqueur, angostura and lemon syrup—, as well as a capirinha of vodka.

Water, a crackling, a rib cake, a hamburger and two other snacks were also consumed. The total spent was R$620. The investigation states that it is not yet possible to confirm whether there are images of Sastre drinking alcohol, but that there is a possibility.
