The Federal Attorney General’s Office (AGU) sent this Tuesday (23/04) to the Federal Supreme Court (STF) factual notice with information that demonstrates the probable occurrence of a crime against the Democratic Rule of Law and against institutions on grounds of the disclosure of confidential information, which was assigned judicial secrecy, of Inquiry No. 4,874/DF, which investigates the undemocratic acts of January 8, 2023.

In the document, the AGU requests the rapporteur of the procedure at the Supreme Court, Minister Alexandre de Moraes, to forward the information to the Federal Public Ministry (MPF) so that the body, which has constitutional competence to propose criminal actions against perpetrators of crimes, can assess whether There was, in fact, the existence of a crime with the identification of the perpetrators.

The circumstances underlying the news sent to the STF were the disclosure, on April 3 of this year, of the so-called “Twitter Files”. This is a set of emails exchanged by employees of the social network of the Supreme Court.

The confidential information was posted by American journalist Michael Shellenberger on his profile on X. In his post, Shellenberger also makes accusations against STF minister Alexandre de Moraes, to whom he attributes authoritarian and anti-democratic measures.

For the AGU, the disclosure via Republic on January 8, 2023. “In a preliminary examination, it is possible to deduce that the evidence of the illegal acts allegedly committed can be extracted from the fact that, in violation of judicial determination, classified information was disclosed, within the scope of criminal and electoral proceedings , as confidential”, highlights the AGU in the news. “(This fact) attracts this central entity (Union) to the desire that those possibly responsible for the practice of possibly criminal conduct that may be investigated be criminally punished, in accordance with the Law”, he adds.

Evidence sharing

In addition, the AGU also sent to STF Minister Alexandre de Moraes a request for access to the entire content of inquiries No. 4,874 and No. 4,957, or authorization to share evidence from these procedures, so that the body can analyze, based on the information contained therein, the possible adoption of civil and administrative measures in defense of the Union’s interests.

In this request, the AGU informs Moraes that it has established, through its National Attorney’s Office of the Union of Public Patrimony and Probity, a Prior Information Collection Procedure (PPCI) with the aim of investigating violations of the provisions of Law No. 12,846/ 2013 (Anti-Corruption Law) and support possible filing of legal actions. The information and evidence produced in the two investigations being processed at the Supreme Court, highlights the AGU in the request, will be essential to clarify the evidence related to the disclosure of confidential information by the company.

“The sharing of evidence is essential for the proper instruction of the Procedure (…) which aims (…) to determine the application of the sanctions provided for in Law No. 12,846/2013 against company X, for acts harmful to the public administration, specifically regarding obstruction of justice and undue influence in administrative and judicial procedures”, he argues.
