TRE-CE accepts disaffiliation of part of PDT deputies and substitutes without loss of mandate – PontoPoder

The Regional Electoral Court of Ceará (TRE-CE) validated the disaffiliation of part of the PDT bench in the Legislative Assembly (Alece) without prejudice to its mandates, in a judgment this Wednesday (3). The Court recognized that parliamentarians have suffered serious political and personal discrimination since the 2022 elections. The understanding diverges, in part, from the report by Rogério Feitosa Carvalho Mota, who accepted two requests from the deputies in full and rejected one of them.

The beneficiaries are deputies Tin Gomes (substitute), Antônio Granja, Bruno Pedrosa, Guilherme Bismarck, Guilherme Landim, Helaine Coelho (substitute), Salmito Filho (graduate), Jeová Mota, Lia Gomes, Marcos Sobreira, Oriel Nunes (graduate), Osmar Baquit (licensed), Romeu Aldigueri and Sérgio Aguiar.

The rapporteur accepted those referring to serious political and personal discrimination and the substantial change in the party program. On the other hand, he rejected what concerned the validity of the letters of consent, considered null and void. The only unanimous understanding among the judges, in fact, was on the first point.

According to the rapporteur, the consents granted to deputies are null and void as they do not respect the resolution of the National Executive, which subjected this type of process to its scrutiny.

Regarding the thesis of political and personal discrimination, he cited examples that illustrated this scenario: the issuance and subsequent revocation of consents, the deactivation of the state directory to install a provisional commission as an artifice to contain internal crises and the dismissal of senator Cid Gomes (today , in the PSB) of the state directory command.

The vote on changing the party program considered the PDT’s rapprochement with parties with “diametrically opposed political orientations”, such as União Brasil and PL – the latter with at least one representative in the high echelons of Fortaleza City Hall, led by José Sarto ( PDT). The rapporteur highlighted that, while this process was being consolidated, the party was the scene of insistent dialogues about an alliance with the PT, with whom it is ideologically close, occasions in which a considerable part of the PDT expressed strong reservations about this support.

“PDT and União find themselves in antagonistic political positions in the Brazilian political spectrum. […] The PDT takes a socialist stance on society, with an emphasis on the need for the State’s intervening role in the economy and its duty to drive social change. […] The Union, on the other hand, presents a social-liberal vision that, by definition, determines that the state must take care of the administrative functions essential for the conformation of the minimum guarantee of humanitarian life, while it must be limited in what must be prominence of the private initiative”, said the rapporteur’s vote.

It is worth noting that the Public Electoral Ministry of Ceará (MPE) issued, on Monday (1st), an opinion opposing the action filed by the PDT deputies and substitutes. For substitute regional electoral prosecutor Marina Romero de Vasconcelos, there is no justification for maintaining the mandates for deputies.

In contact with the Northeast Diary, the president of the PDT national executive, André Figueiredo, said that he will await the judgment of the appeal that the party will make to the Superior Electoral Court (TSE) to, finally, pronounce on the matter. The report also sought out the party’s state command, represented by Flávio Torres, who said he did not like to comment on judicial decisions, “which must be complied with” and “can be appealed, when appropriate.”
